    From memory (and it gets worse every day), there was a guy in NSW a
    while back who got sh*t faced, slept in his car in his driveway and the
    cops knicked him as the keys being "in the vehicle" showed intent to
    drive (the fact that they woke him up notwithstanding).

    I guess it all boils down to whether or not the arresting officer got
    one the night before.

    That's the catch-22 of drink driving. Driving when under the influence
    of alcohol is banned because the alcohol affects your reactions and your
    judgement and yet, that the penalties for drink driving are among the
    most severe for any driving offence, implies that you should be held
    fully accountable for decisions you make while under the influence of
    alcohol, as if your judgement was not impaired at all.

    I bet 95% of people who get caught drink driving would, when sober,
    never consider the penalties of getting caught when drink driving to be
    worth the risk of getting caught, which proves the anomaly/absurdity.

    OK, Nev, so are you arguing that because someone is pissed they should
    somehow be allowed, or at least, not held responsible for what they have
    done when pissed?

    Woods Point copper tried similar on a mate...
    He parked across the road from the pub facing the wrong way.. Copper came
    into pub yelling whose fuckin car is that over there facing the wrong way...
    Richo said mine.
    Cop said move it.. Rich said not in a million years, been drinking all arvo.
    Cop yelled move it or I'll impound it.

    Mate took the keys out of his pocket to throw to his wife, and the cop started
    ranting about intent to drive, your fucked pal blah blah blah.

    Richo's missus had been videoing the whole thing on her phone. The copper
    changed his tune as the 20-30 other people in the pub told in to GAGF. Car
    was moved then and there, but didnt move the next day at all. Bettin the
    cop was waiting behind any bush to **** him up.

    Easy solution. Make a habit of not doing it. I know if I have one beer
    (most of the time) I will want ten and I know what my will power is like
    and I am intelligent enough to know that any amount of alcohol will
    erode ny judgement (married and divorced three times). So the golden
    rule is: If you are going to drink - get a cab / bus / lift or don't
    have a drink. Not even one. I'm not a puritan - I just know how my
    addled brain works under the influence and I make allowances for it.

    How did I get to this? An acquaintance of mine many years ago was on his
    way to court to answer a high level drinking charge. He was /driving/ to
    court whilst sipping from an orange juice bottle - half OJ and half
    vodka. On the way to the court he ran a pedestrian crossing and killed a
    young girl.

    That was when I stopped drink driving.

    booking you achieves?

    As for those others here with no sympathy for your plight, that's OK, karma's a

  14. Just an addendum to this story, after a month of no driver's licence I
    got my day in court on Monday. Because I plead not guilty and
    presented my case, the magistrate had no choice but to adjourn the
    case until witnesses (ie the 2 cops and the breath analysis guy) could
    present their case. In 2 months time! Fark.

    Anyway, there's a guy in a suit sitting just down from the magistrate
    and he beckons me over when the magistrate finishes with and quietly
    asks me for my mobile number and is it OK to ring me later in the day.
    I thought he must have been legal aid or something but fine, any help,
    and gave him my number.

    3pm that afternoon he rings me. Turns out he is the police prosecutor.
    He had listened to what I had said and believed I was being dealt with
    harshly. He rang the police officers involved and they confirmed that
    I had been polite and not belligerent (but drunk) and he decided that
    the police department would withdraw all charges against me. I still
    have to go to court in 2 months time but as charges have been dropped
    there will be no case. He has notified motor registry that the charges
    were made in error and he sent me a letter stating that case. I took
    that into Registry today and I now have a temporary licence and my
    plastic one should arrive in a week. Win. Well apart from the cost of
    taxis over the last month ...
