Who live near N1?

    To Whom It May Concern,

    Please find enclosed your "Notice to Owner" for penalty charge notice
    xxxx. I have this evening spoken to an agent on your service desk who
    confirmed the penalty charge has been sent to me due to an error on
    your part.

    I would like to confirm that my vehicle with registration EO02 MYK is
    not, as you have incorrectly stated a "Vauxhall/Blue" but is in fact a
    Kawasaki ER-500 Motorcycle. I can also confirm that my motorcycle has
    never been to north London and I haven't been near Islington for
    years.

    Your letter was unnecessarily hostile and I do not appreciate being
    put into the position of having to take valuable time out of my
    already busy day to write this letter because you tell me (and I
    quote) "You are legally responsible for responding to this notice."
    Due to the incompetence of your staff I have been inconvenienced.

    I am not impressed with your threat that "action will be taken by the
    Local Authority to recover the sum due, through the Traffic
    Enforcement Centre at Northampton County Court. If a debt is
    subsequently registered against your name and if it is not paid and a
    warrant is issued, the debt will be passed to a bailiff service for
    recovery."

    I must also point out the Data Protection notice on the rear of the
    demand. You state all data is processed in accordance with Data
    Protection Act 1998. This act states that data must be stored in a
    secure fashion and must be accurate. If it is incorrect the grieved
    party is entitled to compensation for distress caused by breach of the
    act.

    I require clarification in the following areas:

    1) How did my details come to be recorded on this ticket in the
    first place?
    2) Why was this never picked up by an administrator?
    3) When you contacted the DVLA to get my name and address why did
    you not cross-reference the vehicle class (Car vs. Motorcycle),
    manufacturer (Vauxhall vs. Kawasaki) or even the colour (Blue vs.
    Black) which would have easily verified that your files were wrong.
    4) When will my details be removed from your database?
    5) You say that my details will be shared with other enforcement
    agencies - have you incorrectly told them any of my details?

    Due to the nature of your error, the demands placed upon me by your
    letter and the considerable amount of time I have already had to spend
    in attempting to rectify your mistake I do not feel it unreasonable to
    expect a monetary gesture to reflect the inconvenience you have
    caused.

    I would appreciate your immediate attention to this matter.

    Dunno about in N1, but down here they take a picture of the vehicle
    displaying offending number plate when issuing the tickets - if dispute the
    offence and then go to court, said piccy is part of their evidence against
    you.

    Might be worth seeing if this is the case with Islington cuntcil, as this
    will be as good a proof it wasn't a bike, than any.

    Actually, this sounds like a good ruse even if the ticket has been
    properly issued.

    It might not get you off, but it'll waste some of their time in finding

    Seriously, why would you talk to the dealer?

    It's thg OH's responsibility to send the relevant form in.
    I've always been able to do it online (recently). You do need the
    reference number from the new-style V5, 'cos they don't seem to print
    the reference on the reminder. With that, it's easy. What problem are
    you having?

    Stuff like this sometimes doesn't get through IME. When the Trophy was
    written off, the insurers had the docs off me before they would pay out. I
    wrote to the DVLA explaining that the bike was now the property of ERS.

    I'd taxed it for a full year when I got it, so there was 6 months tax still
    on it when it was hauled off to the knacker's yard, before I could retrieve
    the disc. About 3 months later, I got a nasty note from the DVLA, demanding
    money with menaces. Apparently it was listed as untaxed from about a month
    after it disappeared, so the tax disc had been turned in for a refund. I
    replied, saying a) **** off, and b) try talking to whoever surrendered the
    tax disc. About a fortnight later, I got another note saying they'd decided
    to take no further action against me.

  16. I'd put a fixed sum they owe you (say £5) say you want repayment within
    seven days, then send them a reminder if they haven't coughed, charging
    them £5 for that and subsequent ones. Then take the cunts to the small
    claims court for non-payment.

    Delivery note. If I have not received this payment within seven days
    this fee will increase 100% to £10, I will also bill each reminder in
    a similar fashion and duration and also for each and every other
    letter I have to send and resend to you in regards to Penalty Charge
    Notice xxxx. I would like to make it clear that I have no issue with
    going to the Small Claims Court to claim these and any other related
    and out-of-pocket expenses."
