What value would you put on a motorcyclists life?

    This opens up a can of worms for me. I was involved in a very serious
    accident, similar to Rod's scenario, yet with more mitigating circumstances
    involved. "They" did very little to determine anything until I took it to
    the supreme court. Even then, reports that I had commissioned from private
    ex-police accident investigators, who completely missed the point and any
    four year old could discredit, were used against me and despite the other
    drivers testimony being found full of inconsistencies and any evidence he
    gave being totally dismissed I was found to be 25% at fault. My barristers
    told me this was a _very_ favourable outcome. The other driver has not been
    penalised to this day and any evidence that his vehicle was unroadworthy
    was dismissed as irrelevant. Then there was the battle for costs that I was
    awarded but received less than a half of! Hopefully the coroners court is
    better at determining such things.

    I also remember reading some case law from a motorcycle accident on/near the
    bridge in Katherine but have no other details to hand, sorry.

    On a Guzzi note, my brother was involved in a case law involving him
    colliding with his mate who had departed from said Guzzi. Bloody dangerous
    things you know!

    I suspect only the best case law appears on austlii :)

    The things they are *supposed* to do are definitely done in some
    cases. I have no idea how you tell if it's done more often than not,
    and no way to back up my belief that it is.

    And just to make it more difficult, there's another case where someone
    overtook at an intersection, but the judge came to the conclusion that
    the driver was negligent.

  6. Nope. Nor mine. But it helps. The next time we want more parking, or a
    better toll rate (Shaddup Victorians. I know. And I'm jealous) we'll get
    a much better reception if the general public doesn't think we're all a
    bunch of revved up idiots who spend all their time blasting through
    school zones at 300kmh.;

  7. Not nice but if the car was mechanically sound and the brake lights and
    Sounds very much like a "What if" to me. If she hadn't been driving that
    car, she could very well have been driving a different one. Or maybe
    someone else would have been driving that or a different car at the same
    place at the same time. None of that matters. She _was_ driving _that_
    car at _that_ time and _that_ place.

  8. This is ESPECIALLY true in NSW if you are driving unreg. If you are
    driving unreg, or doing something similarly stupid, and you are at fault
    in an accident, be prepared to get pinged for EVERYTHING possible that
    you did wrong, including neg drive, dangerous drive, reckless drive, etc
    etc etc.
