  2. I've used small claims court successfully several times with no lawyer
    needed, including once when the defendant i was filing upon had legal
    counse present, and i prevailed in that case too. It doesn't make much
    difference to me if there are lawyers present. i have a decent grasp
    of the legal and business protocols necessary for my purposes.

    However, I believe that denying the right to counsel for claims under
    $5000.00 would potentially inhibit due process and right to a fair trial
    for those not so knowledgeable about the legal process and who would
    have viable claims or defense for cases under the $5000.00 limit. not
    everyone can argue their case well in front of a judge, even if they are
    legally in the right. denying them counsel would be wrong.
