    As EKS I expect them to be able to 'hire and fire' me as they see fit
    that's why most places employ contractors, and I get paid over the odds for
    it.
    You'd probably laugh if you saw how much /real/ work I did, but the users
    seem to like me.

    TUPE regs are only effective for 90 days from initial transfer of the
    undertaking, it is very limited in protection with regards to work
    'contracted out'. Although this is under review but don't hold you
    breath the CBI are busy lobbying the /labour/ party.

    In essence it gives limited protection to employment rights on a transfer
    or change of ownership (there are exceptions e.g. share acquisition etc.)
    but little in the way of protection of *employment* beyond 90 days.

    IME TUPE isn't worth the paper it's written on.

    The direct dealings I've had with it were pretty useless. We were
    nominally transferred to a "wholly owned subsidiary of the British
    Railways Board" subsequent transfers i.e. privatisation the *very*
    limited protection offered by TUPE no longer applied. In the end it was
    more the industrial threat that protected conditions and employment.

    It's been a long time since I've had to use or know the legislation 'in
    anger' so, in hindsight, I may not be the best person to be dishing out
    advice. Especially as it was amended in 1999.

    Local Authorities may have other reason to be very wary of it. I may
    even go mad and look it up. Hmmm, LRD fun fun fun.

    It certainly wasn't much good when my new employers ripped up my
    contract last year and gave me a new, worse one, to sign.
