TOG Valuation please.....

    TOG (or any other journos).....can you tell me what the going rate would be
    for somebody who provides (stunning) pictures with an article? Lemme give
    you an example what I mean:

    All the pictures are mine. Also, who holds the copyright and how can I prove
    these pictures were taken by me?

    If you took them then they are your property. Unless you used a regular
    camera and have the negatives, I'd guess that proof isn't going to be
    easy.

    Pix extra - sometimes not much extra just for illustrating a text piece.

    And you have copyright.

  5. You hold the copyright unless you signed it away under contract to the
    'paper. If you still have the original digital pics (I assume you ask
    because they're not film pics?) all you can do is point to the file
    dates on the pics on your hard drive or wherever they're stored, and
    that's not very conclusive 'cos of possible date fiddling.

    Is there some dispute over the copyright or payment?

    Digital watermarking would be a good idea for the future...

    There's so much a dispute as to: I asked for some of my expenses paid back
    as payment so to speak and the journo basically told me to **** off. What
    makes things a bit worse is that he's a collegue. This whole experience has
    cost *me* about 200 quid so far in loss of earnings. As said, this was a
    good experience and especially as I'm in the beginning stages so to speak,
    I'm certainly not after earning anything, just part of my costs back. The
    guy *is* making money out of it.

    Some of his choice words:
    'I can pay for someone with a profesional high speed camera that has to
    develop the photoes and buy film for different lights and weather. But not
    for some digital camera'. Then again, my photos were of sufficient quality
    and standard to be used by a large national publication!

    'Payback is the glory and excitement of riding with me.' This will be the
    point I can tell him to **** right off in a very big fucking cloud of
    smoke.

    Another thing that irritates me a bit is that the (minimal) cost of the
    trackday has been paid by me as well as the diner and breakfast at EOSM. I'm
    still waiting for him to pay me back. I'm not the kind of person who begs
    for his money, but that as well as the above is indicative of the kind of
    person he is.

    Ah well, you live and learn eh?

    costs to be taken into account.

    Wow. He sounds like a total egomaniac. And an utter wanker.
    The EOSM? He was over in the UK? At the EOSM? What a freeloading bastard
    if he let you pick up the tab. Different story entirely if it's a
    corporation - it's expected to freeload there, but to blag off a
    privated individual is not on.

    If you still have the original images then google for an EXIF veiwer that
    will show all the image settings. you can ask this to be checked on their
    copies

    has he? most companies have rules about working for more than one
    employer.
    How much is he making? How much upset can you cause to threaten said
    income in order than he recompense you your due costs.
    And the answer next time is "well he will charge you £x but here is my
    business proposal and draft contract that will cost you only £y".
    Oh for goodness sake. Kick him off the top of a derbyshire cliff and see
    how he enjoys the glory and excitement of plunging to his death.
    Well I guess you do. Next time, if there is one, bloody well make sure
    your copyright / intellectual property rights are asserted. Perhaps the
    Veggie one might be able to give some guidance on the best way to deal
    with this sort of problem - barring kicking the living shit of scumbag
    "colleagues"?

    EKS, besides, I don't think our employer really gives a toss as long as we
    don't work for another Oil-company.
    Not thousands, but that's beside my point. The only thing I was after was
    (part of) my expenses back, I've explained to him a few times that I'm not
    after earning (yet), this is more of an experience for me, so I factored a
    bit of a loss into the picture.
    Colleague knows this (i hope), but I think he was trying to make a (very
    poor) point.

    I will try to avoid a situation like this in the future. I regarded him as a
    bit of a friend. He';s been to my house a few times, I've taken him along to
    the EOSM. As far as I'm concerned, that's over now.
