Today's entry in the "Shouldn't Have a Licence" files

    At the servo today - I'd already paid for my fuel and was
    just putting my helmet & gloves on when I noticed this car
    coming in at what seemed a fairly quick pace. I thought to
    myself "I hope she sees that I'm here, and doesn't try to
    zoom into the pump where I'm standing". Fortunately she
    didn't try to go where I was, but zoomed in on the the other
    side of the pump that I'm standing at... And straight into
    the arse of the car that was stopped at the pump in front!

    From what I could see, her vehicle was the only one that
    suffered damage, and only minor at that. I had to get back
    to work so didn't hang around to see the outcome, but heard
    some choice language from the owner of the front car!

    The police may be interested in a sworn statement from the driver of the car
    in front. Several of those statements build a case for licence suspension.

    It's a moot point whether the area concerned is a "road related area".
    If it's not, then there would be no grounds for licence suspension, and
    unless there's some reason to think the crash was deliberate, no reason
    for police involvement at all.

    The definition of "Road Related Area" appears in

    http://www.austlii.edu.au/au/legis/nsw/consol_reg/rr2008104/s13.html

    Relevantly:

    "(d) an area that is not a road and that is open to or used by the
    public for driving, riding or parking vehicles."

    While members of the public undoubtedly drive their vehicles over the
    area adjacent to the fuel pumps, it's less clear that it is used for
    driving. Its use is for fueling vehicles, which have to be stopped there
    for the purpose.

    Nor do I think that a vehicle is parked there while it is stopped.
    "Park" is defined in the dictionary, albeit in a way that raises
    questions about whether it applies to the definition of road related
    area. It embodies the concept of allowing the vehicle to stay. I don't
    think a vehicle being refueled can be said to be parked.

    So I think it's at least arguable that the area adjacent to the fuel
    pumps is not a road related area.

    I saw one this morning.

    Driver in lane 3 wanted to go to lane 2, but there were other
    vehicles.

    Other vehicles were slowing down, so a long truck carrying cement
    powder was already WAY too close to the car in front for 70KPH.

    So driver attempted to sqeeze in front of it with about 2.8M between
    the rear of car and front of truck.

    What interested me most was I got some kind of bizarre psychological
    reaction from watching it happen where I SO didn't want the driver to
    do what they were doing, I was shaking my head - as if that would do
    any good.

    She thought better of it and went into a larger gap in the line, three
    cars further ahead. Phew!
    I had a look in the side window and it was a ~25yo blonde woman
    holding her mobile to her right ear.

    So it seems that it would be relevant to hand the police a sworn statement
    if a driver ran into your vehicle in a service station because the road
    rules apply to road related areas. Road rules 2008, part 2, division 1,
    rules 11 and 13. It would be a little perverse to declare an area for
    parking cars a road related area and a service station not a road related
    area.

    If you saw how one of my relatives drives, you'd get off the road.
    Thought she could just barge onto the freeway without giving way, also didn't
    know what the curb side yellow line meant until I told her 'don't *****ng park
    there'.
    Nope won't do a road rule refresh. She can drive.

    She can drive until the police charge her of she has an accident and then
    the police charge her. Sadly some innocent person may be badly injured
    through no fault of their own.

    I asked QT by email and they basically said, drivers not knowing the road rules
    was not their problem :-O

    Not much chance of road rule refresher courses then.

    Well since you mention it...
    Reckless behaviour, creating unnecessary expense, ignorant
    of what is going on around her, incompetent, ... sounds to
    me like she is qualified for life membership along with
    Hawke & Whitlam.
