    Despite the fact that a witness who saw the bike and rider just before
    the fatal accident claimed that in her estimation he was 'travelling
    faster than the 30 limit, possibly 45 mph'.

    What's the betting he had a nice aftermarket exhaust on, and the fact
    it was noisier than stock gave her the impression that the bike was
    exceeding the speed limit?

    Eye witness accounts can be ignored, as they always seem to judge speed
    wrongly.
    Or an FZR250RR, those are good for sounding very fast, while actually
    being quite slow. :)

    I'd say 'should' over 'can', as the 'eyewitness' account of Mal's
    riding prior to his fatal was very damning, and I was very surprised
    that it was allowed as admissable evidence and had an outcome on the
    case itself with the BMW driver who hit him head on, on his side of the
    road.

    But, you live and learn.

    Indeed. The exhibition of speed can be quite damming 'evidence'. I think
    that in the USA in some states, they make it a crime to exhibit speed
    even though you could very well not be breaking any speed limits.
    It's fast for what it is, and it will wheelie as I found out. You have
    to clutch it up from over 12000 rpm in first or second...err.. so a
    mate.. err.. told me, officer. :)
