THE TRUTH speeding and demerit points

    Hi guys,

    There has been a lot of talk on the "demerit and speeding" thread, a lot of
    crap has gorn down and I think you should all know the truth about demerit
    points and speeding in NSW. I'm posting this as a new message so everyone on
    this news group will know the facts as its obvious from the thread that
    there is much confusion and speculation on this subject.

    Point 1

    If you are a gold license holder and you loose 12 points over a 3 year
    period (not 1 year as posted on the thread), your license is suspended for 3
    months.

    Point 2
    If you are fined for traveling more than 30km over the posted speed limit
    your license will be suspended for 3 months no matter how many points are
    left on your license.

    Point 3

    I was riding around thinking that I had all my points and a fine would be a
    minor setback though an expensive one.

    Just be warned and check your points at the RTA web site.

    How the demerit point system works

    The demerit points system allocates penalty points (demerits) for a
    range of driving offences. This means that a driver commences with
    zero demerit points and accumulates demerit points if he or she
    commits offences that attract points. For example, speeding, not
    wearing a seatbelt, failing to stop at traffic lights etc.

    Why can I still see demerit points on the RTA myRecords on-line
    system three years after my offence?

    If a licencee accumulates a certain number of demerit points, his or
    her licence will be suspended. The number of points varies for
    different licence types as follows:

    Full unrestricted licence holders (gold, silver or magenta) - 12
    demerit points in any three year period.
    Provisional P1 licence - four points.
    Provisional P2 licence - seven points.
    Unrestricted licence with a good behaviour period - two points during
    the good behaviour period

    Your demerit points will be counted for three years (unless you have
    been suspended from driving). However, due to record keeping, demerit
    points may be visible up to four months after the three year period.
    The demerit points apply from the date of the offence. It may take up
    to four months after the offence is committed before the offence is
    referred to the RTA to record on your driving record. Therefore, the
    RTA myRecords on-line system will display demerit points total for
    the previous 40 months (three years and four months).

  2. Then what happens? All your points cleared? Or only those that took you
    over 12?

  5. Only those that took you over 12. BUT, if you are on 11 points, and do
    25 over in "Bonus Round", and score an extra 6 points, the whole 17 will
    get cleared. Of course, 17 points will kinda keep you off the road for a
    little while.

    It's actually possible, especially in bonus round, to clock up 2 license
    suspensions in a row, by doing 12 points worth of offences, and then
    ANOTHER 12 points worth of offences before the first set are fully
    processed (ie paid).

    The only confusion and speculation on this subject I saw was
    the bit where you failed to read and interpret the government
    web site that thoroughly and properly explains the matter.
    You've gone and gotten it all wrong again in this post too.

    I was under the firm impression that demerit points didn't go away at
    all until you'd gone 3 years without _any_ infractions, making it
    possible to accumulate 12 points over just under 36 years by getting 1
    point every 2 years 11 months and 25 days.

    Assuming there is an offence that you can get 1 point for.

    But reading the RTA website I have not only been unable to confirm
    this, but have come close to accepting the OPs conclusion.

    You get the points back 3 years after the particular offence, not 3 years
    undetected crime.

    Play your cards right (ie: be consistent), and you can lose four
    points per year, forever, and you'll be fine, pardon the pun.

    I coundn't find the bit that says how long your points were counted for, The
    news group said 1 year the RTA 3 years. Search the RTA wed site and see how
    you go!

    You don't work for the RTA do you?

    Which part of "12 demerit points in a three year period" is confusing
    you? If you can't understand how the simple demerit points systems
    works do you think you should be allowed to drive or ride on the roads
    and potentially enter more complex situations, like roundabouts and
    freeway entrance ramps? You might be a danger to the community.

    It's almost certainly 3 years. I'm just not certain about the details.
    When I got my licence, it was 2 years "between the dates of the
    offences". I don't know why they would go to a considerably more
    lenient arrangement.
