speeding - no number plate photo

    Hi

I know if you're guilty you should swallow the pill, so this is purely
    hypothetical...

Suppose one is caught with a front facing manned camera. The policeman
leaps from his van commando style to manually write down your number
plate as you pass. Two weeks later, NIP duly arrives claiming to be
backed up with photographic evidence. The photographic evidence shows
an unidentified bike allegedly speeding. Is "I don't remember driving
along there and my number plate doesn't seem to be in the photo" a
    runner?

    Like I say, purely hypothetical.

From my understanding, the type of system you're talking about doesn't take
a photo, but just uses numberplate recognition, or am I wrong?

You pay up, like I did in the same hypothetical situation. The
policeman is a witness to you speeding. His word is good enough in
court when backed up by the photo whether it shows your plate or not.

How do they 'hypothetically' know that it's you?

It's not unreasonable to ask for any further info though, and in my case
there seemed to be enough doubt about the whole thing for it to be dropped
    before a court appearance.

I had a theory about it:

If you question the NIP/summons, and offer anything like a remote
possibility that it wasn't you/you're going to fight it and have a better
than tiny chance of succeeding, they will drop it. The thinking behind this
is that then only the "dead certs" get prosecuted. Come the end of the year,
plod can then come back and say "90% of cases that came to court result in a
prosecution", rather than the less impressive "65% that we issued an NIP
    for..."

    Just a theory.

Because you fill in the form saying it was you when you know that you
were on that road at that time.

But they have to actually catch you first though, don't they?

Er, well the copper wrote down my reg, asked the DVLA for who owns
that bike and sent me a letter. Not hard.

Oh, doh! I read the first post wrong and interpreted it as the numberplate
not being visible at all. What a mong.

I think the court might have something to say about the cop leaping out
commando-style. What had he been doing in the back of the van?
