Speeding fine...what to do??

    As I said before, if you read it. The orginal post made reference to a
    dictaphone set up in a detectives pocket. It made no reference to a
    video setup in a car. So, your arguement doesn't mean shit because I
    have not been talking about your little world's wildest police videos.

    Again, Listening Devices Act 1984 says it is illegal to make voice
    recordings without prior knowledge or consent. The loophole the police
    tried to use and now have regulation on is if a device was running in
    the background and it accidently picked something up which is what
    they use "in car" now. Yes you are correct on that. But that is "in
    car" only (ie the system has to be hard wired into the car)

    Different story when they are out of the car and have something in
    their pocket which is what the rest of us out here in the real world
    are talking about.

    If you insist on talking about video and a car again, I may just very
    well kill thread you.

    I don't know about "break into someones house" but I know people who
    break into someone's office is formally called "private detectors".
    It has nothing to do with this case of course.

    Tried that it did not work cop tendered tape and transcript, I objected and
    was told by magistrate that it was not illegal.

    Bar room lawyers just haven't got a clue.

    We've been through this before.
    It's perfectly legal in Queensland for anyone to record a conversation in
    which they are a participant.
    No permissions or copies required.

    Without a doubt, the law varies from state to state to territory. And there
    would be variations again for situations where federal jurisdiction is
    applied, however, the relevant point is as to whether or not such a
    recording is admissible as evidence in court. Do you know about that for
    Qld?

    Can you post the details of this legislation?
    I'm sure that it's only for when neither party in the conversation has
    knowledge/consent.
    When one of the parties to the conversation has consented then all is well.
    (Provided you're not breaking another law like the communications act but
    taping a telephone call).
    Using it as evidence in court may still be illegal in NSW but taping it is
    fine. (In my understanding)

    Well Boxer had it used against him in court! (I assume in Qld)

    I've also been taped twice (that I've noticed) by Qld coppers but I
    chickened out and paid up both times.

    36 or 60 k's over you knew you were speeding you got caught red handed pay
    the fine and take your medicine, or fight it in court either way it is going
    to cost you. If you can't afford the fine and the loss of licence don't
    speed it is as simple as that.
