There's not much chance of a type approved speedo overreading by _at least_ 10%. The Road Vehicles (Construction and Use) Regulations 1986, as amended, permit only speedos that meet EC Community Directive 75/443(97/30) or ECE Regulation 39. The rule, as far I can find it, is that the indicated speed must not exceed the true speed by more than 10% + 4km/h.

ACPO is/was 10% + 2mph which is 46 in a 40. However, depends on the camera authority as they may operate their own "zero tolerance" or similar policy of higher or lower trigger. Guess you'll just have to wait 14 days to find out.
