Riding under the influence - bicycles OT

    so you say "I'm not pissed" what then? do you have to be under .05,
    or just "under the influence"?

    Can you demand a breath test, or do you have to go to the station and
    find someone who will do a blood test?

    Water Police here (that's the Sydney ones, not the Melbourne
    ones) occasionally make a big deal (public holidays, etc) of
    random breath testing on the water.

    Me, I think it's UnAustralian, being sober and in control of
    a powered boat!

    If you say "I'm not pissed", then you're fine. It's when
    you say "Maaate, I'm fine, I'm fine, I've just had a mouthful
    of lite beer! You're not gonna book me, are you maaate? I'm
    fine" and then proceed to puke on the officer's shoes that
    you're in trouble.

    GB, reminds me of a time when a mate of mine was holding me
    upright in front of a pub bouncer making solemn
    representations as to my sobriety and the appropriateness
    of my continuing presence in the establishment. Then he
    slipped and fell, landed on top of me.

    Same deal in Melbourne for a bloke who has one of those tourist buggies
    towed around the CBD by a couple of horses. He got pinged for using his
    mobile phone while the horses and cart were in motion. Got off because
    his defence was that he didn't need to concentrate on what he was doing
    because the horses knew where to go and where to stop and to stop for
    traffic and red lights etc without him specifically giving them
    instructions.

    Sounds fair and reasonable to me. The cop that pinged him
    was probably a young bloke who didn't know anything about
    horses!

    No, no blood test or breath tests, as its not just for alcohol.

    Its my observations of you, ie you have to be pissed or stoned enough for it
    to effect you, and your actions would display that, such as he was peddling
    all over the road, his eyes were glazed and he was unsteady on his feet, he
    spoke rappidly and his speached was slured to the extend that he was unable
    to be understood.

    next time your mate has 2 drinks, look at him and try and say what his
    actions are that would prevent him from driving. then when hes finished the
    carton try it then. difference between 0.05 and 0.230?

    and as somebody else mentioned, it doesnt have to be on a road or a road
    related area.

    its all to do with what legislations it comes under, the DUI is in the
    crimes act, and thus has different deffinitions.

    to the Judge to decide .... Best of luck

    The "randomness" of these tests is somewhat debatable. The WP and
    Maritime can find lots of candidates for testing just by observing
    various rules and limits being disregarded.
    I think that yachties can be tested, too...dunnno about paddlers and rowers.
