Riding under the influence - bicycles OT

  1. I know this isa bit off topic, but a discussion has come up whether
    it is illegal to ride a bicycle under the affluence of incohol.

    I've googled Tassie's laws as much as I can and it specifically refers
    to cars and motorcycles, but not to bicycles in the bit about drink
    driving. Yet bicycles are mentioned elsewhere under these laws.

    I vague recollections of a someone I knew getting booked years and
    years ago.

    Any policedudes on here (or anyone come across this before) able to
    clear this one up?

    I'd be very surprised if you were allowed to ride a treadly over the
    limit, but cannot find any reference to it.

    Dunno about over there but it definitely is over here, and it applies to
    any vehicle, even horse driven as well as water craft.

    In Qld people have been booked on bicycles, horses, horse-drawn coaches,
    wheelchairs and even roller-skates!
    (I think the horse bloke got off)

    over the inkahol limit on the road is applicable , even riding a donkey
    / horse .

  7. That's what I would have thought. If you are on a public road, then
    you have to stat under the limit surely.

    I remember seeing it on the news these two guys in Townsville getting done
    DUI on pushies coming home from the pub.

    I guess they were just fined. Losing points on your license would be a bit
    rough.

    As I understand it, it is an offence to be drunk in a public place
    leading you to disturb the peace, cause trouble or otherwise be
    annoying.

    So if you are on a treadly and you look pissed, they will do you for
    that, but I don't believe they can breathtest you at an RBT, nor can
    they do you for .05, you have to be officially drunk same as a ped,
    not a bit tipsy as the driver of a motor vehicle.

    In Qld if you get done drunk-driving on a bicycle you lose your car/bike
    licence and then you have to use a bicycle.....

  11. That sounds right (distinction between vehicle and motor vehicle). Mind
    you, back in the day when police radar was a bloody big box that had to
    sit on the ground, I knew a bloke who rode his treadly (after several
    drinks) straight into the cop sitting behind the box. At 1:00am. They
    threw the book at him, including DUI. I remember he lost his licence.
    May be he threw himself on the mercy of the court and the magistrate
    didn't see the funny side.

    Down here public road isn't the criteria, otherwise they couldn't book
    boat owners etc.

    I wonder how that ties in with the breath testing of motor boat people
    that they've done down here? Maybe a registered boat has a seperate
    offence?

    Doesn't even have to be public place. You can be done for drink driving
    on private property.. but not speeding.

    Its not a PCA offence, its a DUI, under the act well in NSW, you cant 'drive
    under the influence' and thats any vehicle, horse etc this includes a
    Bicycle. Its not a road side breath test with a macine, its soly on the
    police observations on you.

    Thats, alcohol, drugs, etc,

    Now bring on some really stupid questions that i cant answer
