Do rear foot pegs have to fold up?? they're worn on the TSX, and thus droop
down then they're in the 'in use' position,
i know i could just get some new uns, but i was wondering if they have to
fold up.. like for an MOT.. i.e can i just weld the buggers in the out
position so making them solid and level, or will that cause any problems..
once i pass me test i won't be on the bike alone anyway, so they'll always
    be in use then.

"The footrests must have an anti-slip surface."
"The footrests, handlebar levers and brake pedal must be securely mounted."

Securely mounted means 'not falling off', rather than 'can be folded up'
