Possible VIC sticker tax?

    Still doesn't answer the question "does this apply to aftermarket pipes"
    though.

    IS it that they've never enforced it but could?

    yes. There's been at least one case been to court about not having a
    sticker in the last month.

    I don't know if there are others in the pipeline.

    Nope. IN fact there is likely to be sticker blanks available in NSW
    soon.

    owners had to fit factory sourced exhausts to their vehicles and at
    elevated prices? I can't see why bikes should be excluded from the basic
    tenets of the Trade Practices Act.

    It's fairly well common knowledge, at least for those riders who've been
    pinged in EPA road blocks (enforced by Victoria Police in attendance).

    Here it's a $500 on the spot fine for noisy exhausts.

    Given its date (1996) I don't know if the same levels apply today.

    And it's the only document online that I can find that states the
    required levels. Vicroads, for example, mentions ADR39, but doesn't say
    what the levels are, only that it pertains to noise levels for bikes.
    DOTARS, the federal government department that administers ADRS says
    that I can buy the CDROM....

    Anyway, I'm hoping that someone rich like Nev.. or Goaty will be able to
    challenge this issue in the full bench of the Victorian Supreme Court,
    with a view to clarifying once and for all, whether our aftermarket
    pipes have to be labeled or not....

    You are required to have a sticker that matches the pipe. If the one it
    came with doesn't, then you have to find one that does.

    NO one is stopping you buying a legal pipe, but you have to have this
    sticker.

    Note that this is entirely separate from the noise issue, and it isn't
    said who provides this sticker, just that it must be present.

    If you get a bastard cop, it won't...
    because the pipes can be removed from the bike without defacing the
    information on them. Unlike NSW which says the pipes must be labelled,
    the Vic regs say the bike must. With a label that can't be removed.

    I bet a bastard copper looking for an excuse would try that on. Now
    whether a magistrate would let them get away with it... that's going to
    depend. If I was a patch club member I wouldn' t bet on it, but a fine
    upstanding citizen might win.

    That was my point.

    That it passed an ADR check in a silly place would be a good way to
    fight a ticket for another bike "But here's this unmodded bike that
    passed ADRs which has identical wording and my sticker's just as visible
    as its is, therefore "visible" must have a new meaning"

    As I say, whether it will fly is going to depend on the magistrate.

    (Alright I'm being sarky,but next subject the bleedin' obvious, and yes for the
    record the ACCC are very interested however they have no direct power as the EPA
    act is somehow not under the ACCCs ambit I forget why now, but they can still do
    a report critical of the NSW EPA/ NSW Govt. which carries some persuasive weight
    if not any legal weight)
