Because he's hit a car that turned out a side turning whilst filtering.

Ah, ok, I'll read his description next time. I thought the pictures showing
him over the white line were just because he tried to avoid the car. Read
what he said now and if he was passing a stationary car which had given way
to the Mundano man, I'd put his chances at well under 50% then.

Dream on, clog-boy. Don't get your hopes up on this one, I have a
feeling you're going to come out on the losing side, I'm afraid.

No, it was a row of stationary traffic, about a half mile traffic jam.
Right-lane was clear, so I overtook. Was just about to get back in in front
of the car that left a gap, but Mundano man came out already. I'm hoping for
100/0% in my favour, won't hold my breath though.....

  9. I'd prepare to be disappointed. I think your reference to the fact that
the car you passed had stopped and left a gap is the killer if I recall
what has been relayed on the group from many previous incidents /
    payouts.

I know it's too late now but always, always assume that if there is a
gap or someone in a queue is waiting that some other vehicle or person
is about to enter / fill / occupy the gap.

Unfortunately I dont think 100% is coming you way, as you were
overtaking at a junction, which is a manouevre usually frowned upon, even
though the car shouldnt pull out without seeing that everything is clear.
Seems like the one who stopped, 'flashed' him to go, he took this as the
road was clear then pulled out.He certainly has a lot of blame for the
accident, but his (insurers) argument will be that you should not have
    been overtaking at that location.

Be prepared for 0%. As you said, you were about come back in where a car
had left a gap - the gap left so that Mundano man could come out. Sorry,
but I think on this one, you will be found to be at fault. If you can get
    away with a 50/50 or a 75/25 (i.e. 75 to you), you'll be doing very well
    indeed.

Actually, Mundanos seem to be extememely vulnerable at the front. I
smashed the front of one in badly (with my Sapphire rear bumper) when
rep-man driving one hadn't left enough braking distance at a
    roundabout.

IIRC, his was undriveable, Mine was fine apart from a split bumper.

I wouldn't have another Ford. Fragile crap.

    Cheers

I drop in and read about 4 posts and find myself agreeing with you *again*

Cloggy, you're a careless ****! no doubt all the oil drained from your
    engine in this incident too....

  15. ouch. hope you're okay now.

Having been in almost exactly the same situation, I can tell you the
chances of you even getting 50/50 are slim.

They even tried to throw driving without DCAA at me, but I got off on
    that bit.
