    Does it really matter? He was convicted on all counts, which sets the
    bar for furture cases of vehicular manslaughter, and he's forfeited
    his seat in Congress, which is more than most people who do what he
    did would have to give up. Whether some other felon gets a new
    boyfriend is not a high priority for me. In fact, we're probably
    better served if some chauffeur gets a job.

    ran a stop sign and T-boned the bike.

  4. in the jankow case, I seem to recall the bike hit the car...
    I am almost sure that when I read the multitudes of light-on-the-facts
    news stories when this first happened that most were quite nonspecific,
    but in fact one in their local paper did say that the biker hit the back
    quarterpanel of the speeding car while trying to brake hard and avoid the
    accident. no question, Janklow ran the stopsign at about 70mph, the biker
    had the right-of-way and no stop (55mph through road)

    Videotape of the car shown on the news last night confirms that. It was
    a horrific impact; the Cadillac was crushed on the driver's side from
    the rear door back. Impact a few milliseconds sooner would surely have
    killed Janklow instantly.

    Of course it wasn't intentional, but his record indicated that he
    recklessly drove that way for many years and likely would have had
    significantly more tickets if he hadn't been a politician. Now what
    would they say if someone took their gun and shot it towards a major
    city every day until he finally killed someone with a bullet. Would
    that be an accident? Bottom line is that this prick was an accident
    waiting to happen and he showed nothing but total disregard towards
    the safety of others and now should pay the full price and losing his
    political career isn't even a small fraction of the price that he
    should pay for ending the life of another! I hope his victim's family
    sues the hell out of him and leaves him without a dime!

    And a few milliseconds later and the biker would have suffered nothing
    worse than stained briefs. Independent of fault, the biker had some
    really rotten luck.

    I might tend to agree with you if Janklow didn't have such a long
    history of recklessness and complete disregard for his fellow motorists.

  13. In the criminal prosecution, his prior speeding offenses were not
    permissible evidence, and the prosecution had to win by "beyond a reasonable
    doubt" standards. (Call it 95%)

    In the upcoming civil lawsuit, the standard of evidence is "the
    preponderance of the evidence" (Call is 55%) and the prior statements made
    by the Senator about his intentional pattern of speeding and being willing
    to pay for the consequences of his speeding will be admissible.

    I sincerely doubt the Senator will enjoy much of his retirement. The same
    cynacisim that the public has about rich politicians using their attorneys
    to get them off from criminal conduct, becomes a bias against them in civil
    suits where their wealth and influence sets them up as targets.

    So let's see....... anybody complaining about the lawyers who convicted this
    guy, or the lawyers who are going to get recompense for the motorcyclist's
    family? Maybe a few lawyer jokes here?

    "Bill Janklow speeds when he drives – shouldn't, but he does," Janklow
    said then. "When he gets the ticket he pays it, but if someone told me I
    was going to jail for two days for speeding, my driving habits would
    change."

    Of course, it apparently never occurred to Janklow that his speeding
    might result in something other than a ticket, eh?

  19. Eh? Pensions AFAIK are NOT garnished. OJ Simpson lost everything, but
    he still keeps the $30k/month pension from his NFL days which is not a
    shabby way to retire.

    So this Janclown, he will likely lose everything he has, but not the
    retirement funds. Unless you can point out something I'm missing here.

  20. I fear the worst: that this will become the new pulpit for a renewed
    anti-speeding crackdown.

    Let's be clear about this, speeding wasn't the cause of the accident nor a
    major contributor to the death of the motorcyclist. Janklow's willful
    disregard of the stop sign was what caused the accident, not the fact that
    he was speeding when he ran it. He could have run the sign at 45mph instead
    of 70 and the result would have been the same.
