TBH we do very few ETs as recourse to law is never a satisfactory solution and does demonstrate a certain amount of failure. It, if anything, was an overstatement to demonstrate the point that despite what 'right thinking people' may, err, think simply stating gross misconduct does not necessarily fulfill the requirement for a lawful termination of contract.
