OT Gatso's and cages

    I was over on the mainland at the weekend for the F1 at Silverstone. (From
    Northern Ireland)

    Leaving Rugby late on Sat night both a friend (following close behnd me) and
    I were double flashed by a Gatso leaving the town in our Avis hire cages. I
    glanced down at the speedo and we both reckon we were a tad under 40mph in a
    30 limit. So what happens next then? I assume they will contact the hire
    company for our details. Is there something about having deliver a NIP
    within 2 weeks of the offence? Assuming they do get in contact both hire
    cars had two named drivers, does it make sense to claim we don't know who
    was driving at the time of the offence? How likely is it there was no film
    in it? After what period of time can I assume they won't be getting in
    contact?

    Without any local knowledge of camera locations England is one miserable
    place to drive a car now, on the bike would be even worse. We have four
    camera's in the whole of NI atm, no doubt we'll catch up on you eventually
    though.

    Riding for riding's sake: B roads or lower A roads is where you want to
    be - reduce speed through villages - but to actually get somewhere:
    motorways at less than a 100.

    Although I think that's been pretty much always the case.

    Anyway, Sussex doesn't seem to bad for poorly sited or sighted cameras.

    Fucking cage drivers - I hope they throw the book at you. Speeding in a
    30 is neither big nor clever, & if you couldn't see a girt big bright
    yellow box at the side of the road you're obviously too blind &/or
    stupid to be driving in the first place.

    I reckon he'll be alright with this ... as long as he doesn't do
    something really fucking stupid, like posting his intention to pervert
    the course of justice on a public NG before hand.

    They only have to send a NIP (first class post or better) to the hire
    company so that it would be expected to get to them inside 14days.
    This is the only one for which the 14 days count.

    With the NIP there will also be a S172 request to nominate the driver
    (this is (in law) separate to the NIP). The hire company will
    nominate you as driver (this can't however be used as evidence that
    you are the driver). You will be sent your own S172 request (I think
    you get a NIP as well). This will be worded in such as way that if
    you fill it in admitting you are the driver it will amount to a
    confession signed by the accused that can then be used in court as
    evidence that you were the driver. If you say someone else was
    driving they will then get their own S172/NIP. Without the confession
    the speeding charge will fail, however, if you don't nominate
    yourself or someone else you automatically become guilty of another
    offence - failing to furnish details of the driver. If you name more
    that one driver you will quite likely be summoned to court and will
    have to present a convincing case to the Mags that you could not with
    reasonable diligence have determined who the driver was. If you get
    caught out lying under oath court by say, admitting you were the
    driver in an internet forum, there's a very good chance you could go
    to jail.

    You probably need to call the expert in these matters ;o) (1)

    UK cannot put points on your NI licence yet BTW, you will have to attend
    court and pay a fine though.

    (1) July 2005 and *still* a clean licence since 1990

  14. You were speeding in a 30 and got nicked (possibly). IMHO you
    deserved it and the fact that it was "late" is not a mitigating
    circumstance.

    So be a big boy and admit it and move on.

  16. Hardly. He was speeding in a 30 which IMHO, (you may not share that
    opinion) is out of order. If you're gonna speed at least do it
    somewhere other than urban 30's. But regardless of where it's done if
    you get nicked just accept it and move on. It's a calculated risk and
    this time the OP lost.

    I never said it was YTC. This was in reply to Krustys comment about being
    too stupid to slow down when I seen a big yellow box. It was late/dark so I
    failed to see it. Do keep up please and quote me correctly in future.

    fact that you did not see the Gatso because it was late and therefore
    dark (mitigating circumstance).
