OT. Dilema - neighbours

  1. My bastard neighbour (two houses down) has dumped a heap of shit car outside
    my house for over three weeks now (back end stoved in, side window smashed,
    covered in rust, front bumper hanging off etc.). When it first arrived the
    tax had expired. I asked how long he intended to leave it there and he said
    someone would come and get it that week. I guess the fact I asked him to
    move it pissed him off as he then taxed it and it's sat there since, he has
    another car that he uses daily. I've asked for it to be moved since but he
    won't.

    I appreciate he has every right to leave it there in it's taxed state but
    it's pissing me off seeing it every morning and it means I can't get my car
    anywhere near my house as the parking down our street is very limited. It
    also lowers the tone of the general area (it's 'Bouquet' damn you).

    As the side window is broken I had thought of opening the passenger door and
    letting the hand brake off to push it down the road to outside his own
    house. How does the all knowing collective that is UKRM think I would fare
    if I was seen and reported, or he reported it having put two and two
    together? I can't see the police taking a report of "my car has moved" too
    seriously but the way my luck goes I can imagine me getting done for
    attempted theft or something. Or should I stop being a miserable **** and
    leave it be?

    unreasonable in expecting to leave it outside someone else's house.

    I wouldn't be inclined to move it myself - what's to stop him from
    putting it back later anyway? If he is a bad neighbour he woun't care
    and it'll justy make it less likely that you'll reach an amicable
    agreement.

    Legally, I think as you do that there is nothing you can do - you just
    need to appeal to his good nature...

    If so then report him quoting this:-


    Removal and Disposal of Vehicles
    Regulation 3(2) Removal and Disposal of Vehicles Regulations 1986
    A constable may require the owner, driver or other person in control
    or charge of a vehicle :-

    - which has broken down, or been permitted to remain at rest, on a
    road in such a position, condition or circumstances as to cause an
    obstruction or as to be likely to cause danger of injury to any
    person,

    - which has been permitted to remain at rest or has broken down on a
    road in contravention of a prohibition or restriction,

    to move the vehicle or to cause it to be moved. See also previous page
    relating to tax dodgers.

    Regulation 4 Removal and Disposal of Vehicles Regulations 1986
    A constable may remove or arrange for the removal of a vehicle :-

    - which has broken down, or been permitted to remain at rest, on a
    road in such a position or circumstances as to cause an obstruction or
    as to be likely to cause danger of injury to any person.

    - which has been permitted to remain at rest or has broken down on a
    road in contravention of a prohibition or restriction.

    - which is on a road or any land in the open air, and appears to a
    constable to have been abandoned without lawful authority.

    Regulation 4A(1) Removal and Disposal of Vehicles Regulations 1986
    A traffic warden may remove or arrange for the removal of a vehicle to
    which regulation 3 applies.



    Or if it is a Lada:

    Section 139(3) Highways Act 1980 - level 3 fine
    It is an offence for a person to deposit a skip on a highway without
    the permission of the highway authority for the area.

    Assuming the tax is legit, there are few legal ways i guess. Though as
    someone else said, if it's unroadworthy, get hold of the council/plod.

    IME These arseholes get bored of trying to keep it on the road and if you
    don't bite soon move it. OTOH A complete prat up the road from me did shout
    of and abuse SWMBO recently (not a wise thing to do it has to be said) He
    now gets her indescribably shite rat micra parked outside his house every
    night, but then he deserves it... ;-)

    If the window were broken, I would have thought there was a high risk
    that the tax disk might get "stolen". And if I remember correctly, the
    offence is to "not display a tax disk" rather than simply not to have
    taxed the vehicle.

    Not that the tax disk is likely to get "stolen" in such a nice
    neighbourhood...

    It may be taxed, but doesn't it also have to be 'road-worthy' to be kept
    on the public highway? If any of the back lights are smashed or it's got
    bald tyres etc a call to the local plod may get it moved. Failing that,
    buy a nice 550/4 rat bike & park it in front of his house ;-)

  8. lol! Anyway, it's a very nice bike now it's been rebuilt - MOT on wednesday.
    And besides, it's in my back garden.

  9. A lorry load of cow shit would be better, I reckon. The logical being
    that because the neighbour's car is in front of his house, G_F can't
    dump his garden fodder where he would like and has to resort to putting
    it a few spaces down.

    Parking on the street i live in is also a problem, so when the space
    outside my house is unavailable I park in the next nearest space. It's a
    shared problem that most of the neighbours have, and we all seem to muddle
    through without too many cross words.

    About two weeks ago, I arrived home from work on the bike, and set off up
    the road to walk the dog, where I noticed a red police notice on the front
    windscreen of my car..."This vehicle has been spotted on the highway with
    no tax, and has been reported to DVLA. You will be liable for up to a
    £5000 fine." or words to that effect.
    Needless to say I was a tad miffed to find this, so I rang plod when I got
    back, explaining that the car IS taxed, but as it's a cabrio I keep the
    disk out of sight. I was told that DVLA would check this and if it was
    taxed then I would hear no more about it.

    Ha! I wrote a few choice comments about the person who reported it, stuck
    it back on the windscreen and moved the car down to the front of my house.

    The next morning the sticker was gone.

    Later that day, I had cause to use the car again, and when I returned the
    space outside my house was not vacant(again), so I parked in the next
    nearest spot which happened to be outside the same house it was outside
    when reported.

    As I walked away from the car, a front door opened, and an aggressive
    voice said:
    "Oh" (acceptable to me, as opposed to Oi), "How long d'you _think_ you're
    leaving that there?"
    "Why, what d'you _think_ you're going to do about it?" I replied. (as you
    do)
    A frank and somewhat heated (on his side) debate about the matter ensued,
    until my petty neighbour said:
    "...cos when I get a car on the road I'm gonna wanna park it outside my
    house!"

    OK so now the twat has proved he's being a twat purely for the sake of it.
    He has no car, and hence no problem, yet has the audacity to demand I
    remove mine from outside his house. I gently pointed out that I might be a
    tad angrier than him as I actually *have* a car which I can't park outside
    my house. He shut up and fucked off back inside.

    He pissed me off that day the petty ****, and for his trouble, he now has
    a lovely view out of his front window of two of the shittiest taxed and
    MOT'd cars I could find. Obviously a few friends and I gave these bangers
    a helping hand in the crappiness stakes, by scraping gouges and kicking
    dents in the panels, along with a few slogans spray painted on the side.

    I also considered registering a car with no tax to his address, and then
    reporting it to plod, just for a laugh, but for some reason I didn't.

    The problem of course is now compounded by having an extra 2 cars in the
    street, and I sometimes have to park round the corner. **** it, I don't
    use the car that much anyway. I think about another month or so to let it
    sink in to his thick head, and then I'll spend a saturday fucking about
    with one of them, so my neighbour has a chance to *politely* ask me my
    intentions. We'll see how it goes.
    Don't do it. He may have reported the conversations to plod as
    intimidation already, in readiness of your antics. ;)
    Leave it. Things like this can take over your life and cause major stress,
    especially when you know that you really don't have a leg to stand on. If
    it ain't him it'll be some other errant motorist. It just ain't worth it
    IME.

    However, on an unrelated note, if you were to perhaps buy an old banger,
    and park it outside his house, he may get the message. Nothing plod can do
    about that, and it puts you on an even footing with mateyboy when it comes
    to negotiating a settlement.

    Having given it some thought and in view of the sound(ish) advice posted
    I'll be leaving for now. It will, of course, be in no state to pass an MOT
    in 6 months time should it still be there though ;)
