    There are two offences, Careless Driving and Dangerous Driving. DWDC&A
    is Careless. Mine was a *lot* worse than that and all I got was a fine
    and points (though they did try to give me a Peckham rolex) - it all
    depends how the magistrates are on the day.

    On the plus side, you can't go to jail for careless.

    What would have been the point in that? It's not like you are or were a
    known serial offender or committed what could be classed as an
    anti-social behaviour type of crime?

    It was a traffic offence, simple as that. OK, so it was a fucking
    serious one, but putting a tag on you would have served no purpose
    whatsoever.

    The justice system in this country needs a fucking good kick up the
    arse.

    Depends on your perspective: maximum penalties are 11 points, 2 year ban
    (without mandatory extended re-test) and/or a 2 grand fine. Plead guilty
    and you knock a third off the maximum.

    Being charged with careless can be shit, but when it means you're no
    longer looking at dangerous (and worse), it can feel like all your
    birthdays have come at once.
    It may actually act as mitigation for you when sentenced. Really.

    As I said at the time, I'd only be able to drive carelessly between the
    hours of 7am and 7pm.

    They'd have put me away if they'd had the option. As it was they tried
    community service but the clerk had to remind them it wasn't an
    available option for the offence.

    Magistrates. Gotta love 'em.

    That's one I've asked but had no answer as yet. In the other direction there
    is a warning sign but not in "my" direction. It was pointed out to me that
    as I know the road such a sign is a moot point anyway. I then pointed out
    that in probably hundreds of times I've been along it I've never before seen
    a queue at that point.

    Was I the only person that had to look that up? I'm at a bit of a
    loss as to why they thought a Rolex was appropriate though.

  12. If there was a 40mph limit, it was there for a reason. Not that I don't
    break speed limits everywhere, but I read that as: "I was breaking the
    speed limit, and when I came across an unexpected obstruction, I was
    going to fast to stop or avoid it."

    And I think the court might, as well.

    As it was a 50 limit, then that's different.

    Are you using an AA or RAC free brief? They provided one for me, many
    moons ago, in a little matter of "in excess of 118mph". Didn't stop me
    getting banned, but did get it down to one month.

    I had a careless driving (well it was called "driving without due care
    and attention" at the time) in 1999. Got 4 points and 100 quid fine.

    I stand corrected - I'd assumed that 'careless driving' was different
    and attracted significantly more harsh penalties than 'driving without
    due care and attention'.

    Ogden has the offence names correct. The punishments for careless are
    quite wide ranging.

    Mine was quite low because they were using it in lieu of a speeding
    charge. I was done by two officers in a panda car that didn't have a
    calibrated speedo. So they couldn't using speeding as they had no
    proof and needed an opinion-based offence.
