NSW; new exhaust noise laws in the offing

  1. They are at it again... from the MCC list:

    The following link is the Regulatory Impact Statement (RIS) that DECC
    have issued to assist with the introduction of the proposed laws.

    The following is Chris Turner's rough outline and by no means a
    complete overview of the proposed laws that DECC will be presenting to
    the government.


    Clause. 18
    "Noise control equipment to be properly maintained"
    A person must not cause or permit a motor vehicle to be used on a road
    or road related area if:

    The motor vehicle's noise control equipment allows the emission of more
    noise than the original noise control equipment fitted by the vehicle
    manufacturer, or

    if an authorised officer (police etc) reasonably believes the equipment
    has been modified in a way that makes it less effective than it would
    have been if the modification had not been made, or

    the motor vehicle's noise control equipment is not securely in place, or

    a temporary noise reduction device is fitted to the vehicle (like a
    removable baffle, even if it is fitted and the vehicle is compliant to
    it's noise requirements) or

    if the equipment allows gas to escape from a place other than the intended
    exhaust outlet.

    And

    A person must not:
    Remove, or

    render less effective, a motor vehicle's noise control equipment,
    otherwise than for the purpose of repairing or replacing it, or

    replace a motor vehicle's noise control equipment with noise control
    equipment that is less effective than the original noise control equipment
    fitted by the vehicle manufacturer. Fine: $200 *

    * Penalty levels
    The maximum penalties provided under the Noise Control Regulation for
    a "Court prosecution" are currently $16,500 for individuals and
    $33,000 for corporations.

    DECC said of Clause 18; The aim of clause 18 is to provide a means of
    detecting noisy vehicles that avoids the cost and time associated with
    noise testing where it is not strictly needed. Noise testing is often
    not required to identify the fact that a motor vehicle's noise control
    equipment is defective, and a simple visual test and aural check is
    all that is needed. However, in cases where noise control equipment is
    modified and the officer is unsure whether the noise control equipment
    is less effective, a noise test should be carried out. Noise tests are
    often carried out by DECC authorised officers to support the finding of
    defective noise control equipment. In practice, a Police Officer's ability
    to carry out noise testing is limited by the cost of the equipment,
    lack of trained personnel, and competing priorities.

    Use of informed subjective (guessing!) assessment to decide a noise
    offence is central to NSW noise legislation. The concept of offensive
    noise underpins the legislation. Powers under the POEO Act and existing
    Noise Control Regulation enable officers to exercise judgement in deciding
    whether noise is an issue.

    DECC urges stakeholders to provide feedback on the new Regulation.

    SO a coupla of months ago I purchased a one year old speedmaster that
    had the 'quieter than a virago' pipes removed and replaced with after
    market slash cuts that are louder - but not offensivly so. Note I
    purchased it from shop with the pipes already done (I didn't ask for
    them to be changed - but was not complaining that they had been done!)

    But reading the above even a 1db increase in noise means I part with my
    hard earned!

    I think they're all closet aliens with lesbian tendencies. I also have a
    bike with a nonstandard exhaust that makes a little more noise than the
    standard but I and almost anyone else who hears it reckons "it sounds
    good" - nobody mentions loud .. but the basis of that legislation pretty
    much puts any "louder than your old pipe" companies out of the market too.

    Sad loss really , gone are the days of a cammy 650 Bonnie at 80mph not
    raising an eyebrow ( and sounded very nice through a megaphoneon the
    Petone motorway into town)

    Are you implying that that makes them bad people?

    It may come as a shock to many of you, but the world is not actually
    full of people who like loud noisy motorcycles, or loud noisy cars, or
    loud noisy children.

    I can live with quiet motorcycles, but would really like noisy kids
    barred from all public places.

    Hear, hear! (especially the ones that have a supersonic shriek that actually
    pierces your eardrums and arrows deep into the brain) - and down with loud
    doof doof that rattles my house - and dogs that bark all effing night - and,
    um, the gits who set off fireworks (or, in the case of my suburb, pipebombs)
    in suburban neighbourhoods when it's not even Cracker (or pipebomb) night.
    And the geeks next door who play their bloody real-time computer
    role-playing thingy all night, with the repetitive bass boom that shakes my
    floor. And the drug dealer up the road with the musical fuckin door-chimes
    that play "London Bridge is Falling Down" at all hours...

    Can't you combine a pipebomb with the doorbell of the drug dealers, would
    solve a lot of problems.

    By the way the term "Pipebomb" is a trigger word for internet terrorist
    searching. But i suppose so is the word terrorist, although how many
    terrorists use the word terrorist is an item for debate in itself.
