    As the article inferrs the Council interpreted the rules incorrectly. Vans
    belonging to larger companies with multiple workers are clearly included
    though.

    Some lawyer on the radio at lunch time said the council was correct
    and that the implication is that the same applied to office workers
    carrying papers or a laptop.

    That's my former colleague fucked, then he carries an official issue
    laptop and some paperwork on investigations and smokes while driving.

    He was challenged by his boss, about it, so he told him that he would
    continue to smoke in his car, when alone, until he was given access to
    a pool car. Within a week, he was assigned a car and developed a
    serious Nicorette gum habit.

    The council spokesman stated:
    I would offer that he and this "wife" were heading to their working
    place and therefore the law applies. The fact that this male wife
    smokes too isn't allowed for in the rules. I note he was getting tea
    bags for his wife, but I'm not sure that is acceptable as an excuse.

    Might be interesting to know the time of the day this happened. I
    suspect that he and this labourer or mate (or WHY) were on their way to
    work which if that's the case, North Wales' finest might be interested
    in his statement:
    My insurance has always covered travel to a fixed place of work but they
    want to know if your vehicle is used on "employer's business" or to
    multiple places of work.
    Laws are designed to address the lowest common denominator. Many of us,
    I'm sure, feel quite capable of handling things like mobiles, smoking,
    drinking, eating etc. whilst driving. While there are people out there
    who insist in driving whilst they can't multi-task to cope with this
    there will have to be laws in place to protect the rest of us.

    Van is used to carry items to place of work, van is therefore a work
    vehicle. It contians items kit to perform work, it is therefore a work
    vehicle.

    If , as I have read elsewhere, he is claiming it was for "commuting" his
    ins co will be *very* interested in this.

    No sympathy, smoking is bad [TM South Park] :)
