  5. Filming people in France is subject to prefectorial authorisation. Unlike
    the UK, you can't just fire up a webcam pointing at the street in front of
    your house.

    Also, a camera in the front of the windscreen would capture registration
    numbers, which are what's called 'nominative' data, i.e. they can be used
    to identify someone. This could _conceivably_ be termed an infringement on
    someone's private life. The fact that the numbers are visible in public
    anyway, wouldn't be a defence. I was filmed without my knowledge in class,
    kicking a girl out (figuratively), and the video found its way onto
    YouTube. I successfully had it removed, as YouTube France (and the little
    bitch who filmed me) would have been penally responsible otherwise.

    When I did Solaris shit for the City of Paris, we had one particularly
    nasty DOS attempt, and I got the IPs and contacted the police. They
    refused to let me forward the IPs, as these too were 'nominative data',
    and thus could not lawfully be transmitted to a third party without a
    request from an instructing magistrate, or an OPJ in case of flagrant
    délit.

    Disclaimer: the IP stuff happened in 2000, and so the brave new, post-11/9
    world (_cf_ the 'Loi sur la Sécurité Intérieure') may have changed that.

    Just curious, are you a lawyer specialising in French law?
    This proves that you can't disseminate videos. Not that you can't make
    them.

    Generally, the way filming and photography law works in most EU countries
    is that you can film and make photos of anybody accessible to the public,
    but you can't PUBLISH them. There is a distinction here that I think is
    eluding you.

    So, it would be perfectly OK to make a movie from a helmet camera or an
    on-board camera, as long as you don't publish the movie. However, using
    it in a legal proceedings would be OK. Which is all it's needed for.

    Also, interestingly enough
    and other movies made in France using vehicle mounted cameras have not
    been removed from youtube.fr

    Not a big market for camcorders either in France then I guess. Tourists
    must be being arrested in droves.

  16. Not at all. But there's a difference between filming your family, and
    walking along the street deliberately filming people. You'll note that in
    TV documentaries &c., passersby usually have their faces 'pixellated'.
    Doing something prima facie 'illegal' isn't always the same thing as having
    your collar felt for it.
