National Helmet Law in Process, Please Read

  1. funny you should mention that. the current helmet law is how Cornyn's
    support was won.

    i had my second conversation with a legislative aid in Sen. Cornyns's
    office today. ( Sen Hutchison's office signed on immediately, the aid
    literally laughing when I mention Lautenberg; she's in our camp). The
    legislative aid to Cornyn was unfamiliar with the current laws, so I
    took five minutes and explained how the Texas legislature had
    promulgated law such that an adult over 18 who had taken the MSF course
    and/or had proof of medical insurance so they would not be a burden to
    the state if thw worst happened was permitted to ride without a helmet
    in Texas. I pointed out that this was good conservative philosophy
    (Cornyn is very right wing) because it simultaneously promoted
    individual freedom and personal responsibility and it was law instituted
    by our very own Texas Legislature. I then pointed out that Sen.
    Lautenbergs amendment was an attempt to over-ride the will of the Texas
    Legislature and the citizens of Texas who approved of the existing Texas
    codes. (This is an important point to make) I then made the point that
    Sen. Cornyn was in the Senate to help protect Texas from being dictated
    to by a Democratic Senator from New Jersey, and that the senior Tx.
    Senator, Sen. Hitchison, was on record against this proposal. The
    legislative aid thanked me for explaining the history of the current
    legislation that allows responsible riders in Texas to ride without
    helmets and that made his job much easier in formulating what should be
    presented to Sen. Cornyn for a position. Basically, I gave him the
    research he needed to go further.

    While Sen. Hutchison was up to speed on the issue, and her aid reported
    receiving many phone calls regarding this topic, it was evident that the
    aids to Cornyn were not up to speed this. That's not terribly
    surprising; state helmet laws will be arcane for folks lost in the
    Washington, DC hubub. Taking the time to explain the history of
    existing law in Texas, how it came about and how he would be supporting
    his state in voting with his other Texas Senator against someone who is
    politically across the aisle was time well spent. No confrontation, no
    name calling, just a solid conversation based on facts. I believe both
    our Senators will vote against Lautenberg's proposal. Further telephone
    support to both Senators in a constructional manner can't hurt. Angry
    confrontation produces ill will and is not wanted.

  3. additionally, this is an attempt by someone from New Jersey, with no
    connection to Texas whatsoever, to override the current helmet law as
    written and approved Texas Legislature. the method being used is
    attempted fiscal blackmail of highway funds. this is not a pathway to
    good law and should be rejected as a matter of policy if nothing else.
