my cage parking ticket

    This is a reply to the issuance of a parking ticket I got last week. What
    are the odds of getting off, considering that 1: all the facts listed are
    true, and 2: it's Croydon council?
    Any reasonable suggestions of alterations will be appreciated, any
    unreasonable ones should as is customary be abusive and/or amusing.

    I was recently (23rd February 2004) issued with a Penalty Charge Notice for
    parking on a single yellow line in WANDLE ROAD, Croydon. (MY REGISTRATION
    HERE) The ticket reference number is CR96457610, and was issued by parking
    officer 253.

    The "Observation Start" section is completed as 1955hrs, and the ticket was
    allegedly issued at 2100hrs. The offence code is marked as "01" which on the
    reverse states is "Parked in a restricted street during prescribed hours".

    Firstly I would like to point out that I did not leave my place of work in
    Penge until 2005hrs at the earliest, a fact which may be confirmed by other
    police officers with whom I work. When this is taken into consideration,
    along with the temporary traffic lights in South Norwood due to the
    roadworks, I believe even Einstein himself could not have provided a reason
    as to how I was able to arrive in Croydon ten whole minutes BEFORE I left
    Penge on a 25 minute long journey!

    Having had a conversation with Mr Rice on the 26th (whose supervisor never
    telephoned me back) I was informed that a "Restricted street sign" need not
    be in place in the actual street, as long as it was in "the zone". This may
    be the case, but until a sign is shown to me in "the zone" I will still
    rebuke the validity of this ticket based on the fact that there are NO signs
    in the area displaying any kind of parking restrictions other than for the
    parking in bays.

    Should you wish to leave your warm office and check for yourselves, the only
    way into the place in which I was parked is from the High Street via Laud
    Road. (MAP) When following this route, there are no signs whatsoever
    relating to any parking restrictions. Perhaps there once were, but there are
    no signs there now and as long as I have lived in South Croydon there never
    have been.

    I would appreciate being contacted regarding the total inexusabilities of
    not only the flagrant lies/total incompetency of your parking officer but
    also the grounds for the issuing of this unlawful ticket causing a total
    waste of my time.

    I am making a video tomorrow of the route into Wandle Road, proving that
    there are no parking restrictions displayed. I also expect a letter of
    apology from yourselves for my wasted time including a withdrawal of the
    ticket.

    I would also like to point out there are no instructions on the ticket
    stating how to challenge it's lawfulness, which no doubt countless wish to
    do if this is the ridiculous way in which you allow your employees to
    operate.

    course you don't; she said words to the effect of " I've looked at the
    parking attendants notes and you were parked on a double yellow line"

    I moaned about the fact that this was unfair as a yellow line isn't
    parked during prescribed hours so she cut the fine from £80 to £40 but I
    still had to pay after she said <paraphrase> "there's **** all you can
    do"

    This is a reply to the issuance of a parking ticket I got last week.
    But by being on a single yellow line at 9pm when there are no signs saying
    that the usual restrictions don't apply should mean I get off, right? (That
    coupled with the fact that the traffic warden twat made a mistake on the
    ticket).

    If saving 40 or 50 quid means that much to you then go for it, but after
    much long and bitter experience I just end up paying the bloody things
    now; it's just a lot less hassle in the long run IMO.

    It's the principle too though. If people like me make a fuss and moan at
    them, they *might* put the damn signs up so people in future know not to
    park there. I hate the little wankers with a passion, and will take great
    pleasure if I get off. I might then sympathise with the next one that gets
    nicked for being an illegal entrant... Yeah right.

    I would push hard to get it dropped, if you are in the right and have proof.
    I decided at 9 points I was going to fight the next "spurious" £60 on the spot
    fine for anything.

    Two weeks ago I was pulled for crossing a double white. 3pts and £60 or court
    sir said the copper. See you in court mate says I. But we have you on video
    says them. Well your video will show the two kids I swerved to avoid then,
    see you in court. Take this caution then NO I'll see you in court!

    I am currently waiting to see the reply to my letter to the Chief Constable
    along with the photo of their illegally parked car.

    I work in HSE so I also asked about their failure to comply with HS regs as
    well.

    I may still go to court but it will be fun!!

    But you're a copper. IMO traffic wardens LOVE coppers as they really do
    think they are
    police you know.
    I had 2 turn up in a police car knocking on doors asking who was blocking my
    neighbours driveway.
    The neighbour couldn't just knock himself because he's a Marty McFly
    character ad,
    "Just couldn't take that kind of.........confrontation."

    Just make sure it costs them at least double the fine in admin costs. If you
    have the time & inclination going all the way to an actual appeal in person
    at their Haymarket offices, it must cost them loads. It's also good fun
    arguing the toss in person. Value for money - that's what you want.

    But it's because so many people take that attitude that it makes it worth
    doing for them and they get away with it. If everyone stood up for
    themselves, I don't think *they* would think it was worth the effort.

    I am currently waiting to see the reply to my letter to the Chief
    They have to give ya the ticket, then you elect a court appearance.
    Unfortunateky, police are legally exempt from parking retrictions, but if
    you happen to come across a photo of them being illegally parked when not
    doing something work related, i.e going shopping, then by all means suggest
    this may find it's way into the newspapers.
    The same thing happened with us in Petts Wood, amusingly enough though the
    photo was taken after 1830hrs and the single white line was no longer in
    force when the two PCs went for their kebab. It still caused a stir and the
    prats upstairs issued them with a notice of intended dismissal BEFORE they'd
    even checked out the parking restrictions!
    It may also be of note that the road markings are always laid out for the
    largest vehicles on the road, HGVs and such, so if you were biking it it may
    be a reason that it was safe to do so. They may not accept it as an excuse
    in a cage though. Come to think of it, what did the copper say and what did
    he issue you with? If he knew that you already had 9 points then he should
    NOT have issued you with a fixed penalty but filled out a process book
    instead IIRC. If he has issued you with a FPN then you may decide that he
    has breached police procedures since you *did* tell him that you already had
    nine points didn't you? That breach of policy and procedue alone should get
    you off :)

    It's fair to say (when I'm working) I get about 10 tickets a week. If I
    really am delivering / collecting or have a legitimate excuse for being
    illegally parked, then I'll send off my sheets / evidence and 9 times
    out of ten I'll get off but sometimes it's just not worth the aggro;
    Experience tells you what you're likely to get away with and in this
    case, IMHO of course, I don't think you've got a cat in hell's chance,
    but I am willing to be proved wrong :)

    so I suppose I'll have to visit my mum more often when I'm steaming drunk
