    Not eligible.
    40 years and over there is some money to pay which is in the range of a
    couple of thousand and that clears you of any military service.

    Methinks you are getting a bit worked up here moike.
    My particular argument is that the magistrate got it wrong on legal grounds.
    The offender admitted she was drinking.
    The police established she was over the legal limit.
    She fled the scene and failed to render assistance.
    Many other cases that have similar outcomes have resulted in instant
    disqualification of a license.
    She is not contesting her innocence, she is awaiting
    retribution/sentencing on what she has done because there is no trial
    in this case as she admitted her guilt in the preliminary hearing.
    I don't mind her being out on bail I DO mind she is allowed to keep
    driving even under certain conditions.
    Others in her situation have suffered worse under the legal system.
    I have also consulted my colleagues at work regarding this matter and
    they seem to also agree the magistrate was being overly generous.
    Please don't accuse me of knee jerking becasue I didn't approach it like
    that.

    Neither Paul, nor Moike are, to use the simplistic term, 'nitpicking', Smee.
    These are important legal lessons and realities, which I am really not
    surprised, as being recognisable, by likeminded souls such as yourself.

    Both are attempting to educate you, as best they can, on certain legal
    realities (inherited and otherwise) which prevail in this Commonwealth and
    its Jurisdictions. Despite some Smee likeminded efforts at 'reform'. So
    advocated by newbie legal and parliamentary legal drafting office personnel
    in our assorted parliaments over the last 34 or so years.

    Many staff of whom I am convinced are afflicted with either mad cow disease
    and alcoholism, or both.

    None of those are legal arguments that would prevent what the magistrate
    did.

    Have you found out yet what bail is for?
    because her punishment should start immediately?
    How many others have been in precisely her position?
    Were they there?
    Do they know all the circumstances?
    Do they know better than the Magistrate who has heard the arguments?
    I don't think I've ever heard anyone admit to a knee-jerk reaction.....
