Legal/Insurance question on restricting to 33bhp

  1. Son is 17, holding restricted A license, currently riding on SV650
    un-restricted. Naughty boy, but knows fucking everything, so you can't
    tell him owt, however, not doing too much riding in this weather anyway
    (it's cold....whimp !)

    Do I need a certificate to say the bike has been restricted, or will a
    dyno run showing bike output suffice ? or do I need anything ?
    (Cos I'm going to buy 2nd hand kit from Christofire, but he may not
    have the certificate)

    The insurance company have not asked for any proof, and my
    understanding is that it is a legal requirement to have the bike
    restricted, but no legal requirement to have a certificate.

    or

    Do I need a to obtain dyno run output as proof ?

    I don't know how you'd go about this. I'll have a look, but I strongly
    suspect the certificate I had will have gone with the rest of the bike
    docs when it was traded in.

    I also don't know if the washers will be any good - when I had the kit
    removed that was what I got back. It will probably be best to ring
    round (the installer, the dvla?) to see if these washers are any good,
    or whether it has to be an approved installer, fitting a brand new kit
    every time.

  4. Legally you need nothing.

    If a policeman suspects your son is riding a vehicle not in accordance
    with his license your son will have to go to an MOT station and show
    that it *is* under 33bhp.

    Certificates are an invention of F1 International and Bike Shops and
    have no legal meaning.

  6. Given it's 100 per cent incorrect perhaps it would be better not to
    refer people to it?

    Or have you got shares in F1 International?

    Agreed, certificates are purely a money making scam.
    I am thinking of setting up a business selling them.

    The onus will be on the Police to prove the BHP.

    completely unenfforcable anyway.

    The police don't have a list of the BHP of every bike ever made. So how
    will they know? If you don't have yuor licens on you the police won't
    always check your license entitlements anyway so they probably won't
    even know if you *should* be on a sub 33bhp bike.

    The legislation doesn't say how to measure the BHP anyway.

    I would be willing to bet that nobody on a restricted license has
    *ever* been randomly asked to demonstrate their BHP output.

    I suspect if a restricted license rider got stopped at 200mph on a Busa
    and claimed it was making 32bhp he'd be asking for trouble - but if he
    doesn't have his license with him plod won't always know he's on a
    restricted ticket?

    This really needs to go in the FAQ!

    Agreed.
    The police could seize a motorcycle they suspected.
    As you say however, they would not know the BHP, unless it was something
    obvious like a Rocket 3.

    When I was sixteen (long time ago) I use to have a good laugh at other
    sixteeners who would worry about rebored 51cc bikes.

    waving a meaningless certificate in their face!
