Really. You don't need to *play* stupid, Brian. No, it appears she waited until she realized I was not going to stop for her. Then stepped into the middle of the highway and tried to force me to stop (something which, by that time, in that short a distance, was not possible). When, lacking the option to stop in time, I swerved to miss her. She reacted to that by diving to get in front of the bike. The fact that she dove (to get hit) was proven by where she sustained her injuries - head smacking the right side of the fairing, lower right arm contacting the right crash bar (shearing off the highway peg which remained inbedded in her arm, so no doubt about that), and left hand hitting my right rear-view mirror. Full horizontal dive (towards the left of the highway in the direction I swerved). Simply put: Crazy behaviour (from a deranged woman who a person with her that morning told police on the scene had been threatening to commit suicide, earlier that day). But that's another thing you shouldn't let get in the way of your foregone conclusions. Or do you agree people should reason like that, concluding your negligence lead to your daughter's death? Getting the point yet? Beside over 6 thousand dollars damage to a costly bike that had been in perfect condition prior to that... I'd say something basically amounting to a failed attempt at manslaughter is quite serious. And, yeah, she did hire some ambulance-chaser to sue me (hoping my insurance company would just give in). They dropped their suit - so strong was the evidence piled up against them. But don't let little facts like that impede your mission to find anything wrong possible, Brian. Unlike animals on the roadway, only a human being intent on committing suicide has the mental planning capability to anticipate (and, thereby, frustrate) what the operator of a vehicle is doing to evade hitting them, so that they can get hit anyhow. That significantly compounds the challenge to miss them far more than is the case with an animal having no plan or malicious intent. By rights, she probably would be dead if I had swerved a little less severe and she had gotten herself in front of the front wheel, but that's a hindsight guess. But, yes, I see where you are going with this, Brian. You have something against me so the only thing that is important is your need to make it my fault in any way you can. As I started off saying, that might be the same reasoning folks like AV use when concluding you are the cause of your own daughter's death. All this back and forth business.... Yes, whether the houses are spaced out or not, we in Texas use caution when riding by pedestrians that are close enough to the roadway to interfere with our path. We have laws down here about hitting pedestrians. Whether they're in a school zone or on the side of a highway...we have laws. Sorry Don, but I've seen too many drunk pedestrians. I've had some get in the street. I've never been anywhere close to hitting them. Instead of you saying "damn, I hit some stupid bitch that was drunk", you instead played it up that she was willfully trying to kill you and all. That would be about as successful as me being a driver of a Kenworth and hitting a motorcycle...then claiming he was trying to kill me by being in my way. Even the RCMP (who were soon on the scene and investigated the incident) told me right away that they had no doubt she had been trying to kill herself. Somewhat unusually, one of them, when contacted by my insurance company's lawyer, volunteered to make the trip to Edmonton (several hours trip) to testify against the woman on my behalf. But of course you, Brian... well, you know better than everyone who was there and you seem to find it so easy to come up with scurrilous charges. Correct. *That* has to do with your hypocritical behaviour; choosing to make up charges that have no basis - something you and your father have complained here about others doing to you. Well, that's the way an honest report is. If I had manufactured it, I would have changed things to make them seem more believable on the part of the woman. I can't get inside her head to know what exactly she was thinking, but it appears to me that her first impulse was to flag me down to get a ride - something I was not willing to agree to. At that point, I also doubt she wanted to commit suicide. High on prescription drugs (a known junkie to the local RCMP) and having been drinking, it might be that she made a bad judgement based on my speed; actually believing I could stop in such a ridiculously short distance. But, when she deliberately threw herself in front of the bike as I tried to avoid her... at that time she definitely tried her best to get hit. Doesn't make sense, but there is no other explanation for it. You can't always always make crazy behaviour seem sensible.
