It's mine until you've bought it

    As the settlement for the write-off of my Tiger has still not arrived
    from NiG (underwriters) I've instructed the garage to withhold the
    motorcycle until I call them back to say the cheque has arrived.

    NiG weren't too pleased with this, who wanted to sell it as scrap or
    whatever before they had sent me the settlement cheque.

    Also, the vehicle is still registered in my name and hasn't been
    notified as sent for scrap or transfer. That's a bit naughty, isn't
    it? Or is it normal to flog the bike from the owner before any
    official notification in writing has been received?

    As mentioned previously, when the Trophy was written off it was carted away
    before I could retrieve the tax disc to surrender it for a refund. Also,
    the insurers demanded I forward MOT, registration documents etc. I did so,
    but also wrote to the DVLA advising them that the vehicle was now the
    property of my insurers. Several months later, it was still registered in
    my name.

  3. I got a penalty notice from the DVLA for not renewing my tax ~ 6
    months after a stolen/recovered bike was written off. Phoned DVLA,
    and they cancelled it there and then, which was much easier than I
    expected....

    Its still legally yours until you receive the cleared funds - what
    happens if they flog your bike and go into administration?
    Give them nothing until you have the money......

    Tax is due for 1st March so I SORNed it as soon the Loss Adjuster said
    it was a write off.

    BLD called me a couple of hours ago saying that a salvage company had
    come to pick the bike up and what would I like to do - I told them I
    do not authorize them to release the vehicle to anyone but myself and
    to continue charging storage on it until I say they can release it.

    NiG, the cheeky bastards, look like they have *already* sold it on to
    a salvage firm!

    BLD called me back an hour after that and said that the salvage firm
    were bickering about paying for storage of the vehicle and as payment
    was in dispute they weren't going to release it to anyone. Good.

    They can't release it until you've received the funds cleared, it's not
    theirs to sell. Legally taht would be obtaining goods by deception and
    therefore you could have 'em.

    I would complain to them about this and threaten to speak to the FSA if they
    don't stop illegal tactics.

    JESUS FUCKING CHRIST, how many people do you think need to offer feedback on
    a simple mistake?!??!!??! 1) it was late, 2) I haven't actually used
    newsgroups until tonight, 3) somebody had already pointed out the issue
    kindly.

    People repeating like that is basically like a bunch of kids on a forum
    flaming one person because they don't like their POV.

    So thanks for the advice but next time read the other posts if it's already
    been given stop being a parrot and leave it be. As for the suggestion that
    I'm a total ****, well it takes one to know one I guess!
