    OK so the seller's first response to my complain is pretty negative.
    It's a small/part time trader working out of his garage I think.
    What's the general situation legally here? complicated somewhat by me
    being in Belfast.

    My first response is:
    Full dealer Repair>Small claims court
    Contact HM IR & C&E to inform them of the sales activity and suggest a 3
    year forensic audit for evaded Tax and VAT.

    his FB is good. I'm willing to bet he never roadtested it properly.

    Exactly so. He used to have a shop, apparently, races, has spare parts
    made by his Thai wife's[1] rellies in Thailand, fixes up and breaks
    bikes

    He's a trader, and AFAIK declares himself as such.
    I think in this instance I'd go for a partial refund to begin with. The
    shame is that the rest of the bike is pretty good. When Timo and I
    looked at it, we were impressed, but obviously neither of us rode it.

    I don't think that he's likely to be doing much tax evasion. he told us
    a hair-raising tale of some Ebay trader of his knowledge who got caught.
    Claims he's all above board. Did he give you a proper VAT receipt? If
    not, then you may have a point.

    I'm pretty certain that his house won't be registered as a motor trader
    with the council, so he's probably in breach there, yes.
    Well, that's why you bought an RD400.
