Oh, sure - that's definitely legally binding, that is.

Indeed, I love the W124 Mercs, but even I'm not insane enough to buy a
    4-matic one.

Wording private vehicle advertisments is a nightmare to make sure you
don't have any come-backs. In law you have virtually no way of getting
any form of recompense unless the seller clearly states that the
vehicle is going to last for anything longer than it takes the him to
get out of sight. I know this from recent personal experience.

Phrases to avoid when writing an advert include "Should do someone for
many years to come" and "It's been reliable for me, I see no reason why
it shouldn't be reliable for someone else". I tend to stick with "It's
been reliable for me" and leave it at that.

If he's saying everything works then that's ok for the seller, unless
he states that everything will still be working later.

But that'd still mean he'd misdescribed it if it turns out that
something as small and insignificant as the 4WD system doesn't work
while the car is still in his possession, correct?

If you try it out and it works at the time, then you have no come-back
if it fails later, unless he specifically states in his advertising or
receipt that he guarantees that it will keep working after purchase. If
the 4WD doesn't work when you test and then buy the car, or you don't
bother to test it, then you're a fool for buying it in the first place
and cannot complain if you later discover it doesn't work any more.

Pssst. Wanna buy a really cheap one? :)

Actually it's not for sale yet, the plan is to flog it once I've moved
    house.

I *did* make it home with the car last night, and it wasn't on the back
of a breakdown lorry either. Although it was close when I discovered at
one point that I had *no* rear lights at all. Fortunately we managed to
trace that to a blown fuse and a missing bulb but still there are a few
screwy things going on with the 'leccy bits.

That said, it seems to drive OK, it's quiet and so far fairly bereft of
nasty noises, especially given the fact that it's done 190k.

More on uk.rec.cars.maintenance in a minute, I'd guess.

    message
The complete rear light failure on these is caused by a current overload
through the interface lock on the 4x4 system. It's the usual 1st sign of
imminent middle differential failure. It's not an immediate thing
obviously, it will usually run on for a couple of hundred miles more.

I think that's Timo's cue to move house and sell it PDQ .. with a nail for a
fuse .. as was found in a Landrover I once purchased, from a 'mate' ..;)

It wasn't a total failure - personally I blame the lack of caffeine
    this morning.

Well, at least not one that couldn't be fixed with a couple of fuses
    and a new bulb.

The more worrying part is that with the fuses in, the rear lights won't
    turn off...

Buy a house first would be a good plan, although I'm >< that close to
    making an offer on one.

Having read the various episodes of Timo's mechanical (and
electrical, obviously) "adventures", it does make one wonder
how good a survey is needed on the potential new house...!

Woo hoo, that niggly stage where if anything can go wrong .....

Seriously though, good luck man, I hate house hunting buying/selling, with a
vengeance after the last one. We don't intend moving now unless we drop
    dead or something .. ;)
