Grrr, warranty

My rear guard got ripped off when I hit a pothole, and it sheared off
a bolt right next to the brake. I took it in for warranty repair
today, but BMW are saying "no can do. Your tires aren't on the
recommended list and have a higher profile tread pattern than those on
the adventure model, so the knobbies got caught on the guard and
ripped it off". I'd love to get tread pattern measurements[1],
because I doubt they're any deeper than these ones:

I'd say defective design, and that's exactly what statutory warranty
was designed to protect against.

Change tyres. Go to another dealer. Job done.

Go to the *other* BMW dealer in Melbourne .. what a cruel joke

Yeah, it sucks that it broke, but the owners manual does list the
recommended tyres, and if you choose something that's not on the list
you've modified the bike beyond factory specifications, and the tyre
probably hooked on the fender and caused the damage.

Even proving that the tyre tread was no taller than the tread on the GSA
model might not help, because the tyre carcass might flex differently to
the recommended tyres, and it seems that the pothole causing the tyre to
flex probably caused it to catch the fender.

If i was you I'd go looking on forums for evidence of some systemic
failure of the fender which is caused regardless of what tyres are fitted.
