  1. Who said it was a final offer?

You do - and you're not even funny with it.

But you know more than the solicitor Gower has been advised by?

  3. No, there are few solicitors who specialise in consumer law.
The facts are simple, if there is a known issue, the SoGA will cover it.

In the context of Madame Gower's GSXR related problem is it a known issue
    admitted by the importer/manufacturer?

No worries - was sitting there gathering dust so it was

Actually I'm not without considerable experience myself. As the
ex-General Manger of Time Computers I handled most of the "interviews
under caution" and prepared many of their legal cases, in addition to
this I fronted for hte press. We only ever lost one case, which, to be
honest, was a surprise. The key to success is knowing when to pull
away. I've always maintained that when negotiating the sign of a good
deal is when *both* parties go away unhappy. I have spoken to quite a
few people regarding the mind set of Suzuki and the general consensus
of opinion is to take the money and run. It would be up to me to prove
that there is a fault and not simply by anecdotal evidence but through
design, metallurgy and actual failures. A simple test. Hands up Gixxer
Thou owners on this group who had their clutch basket fail. <looks
    around feeling lonely>.

To be honest, I have fought literally hundreds of cases where the
consumer tried to sue, these included Time, LG Electronics and Quantex
plus others. I know the tricks their legal teams can get up to, hell I
invented some of them. They cannot possibly accept responsibility for
a failure. It could end up costing them a huge amount of money and
reputation. For me to press them would probably have cost me several
thousand pounds and possibly a few years of time. TBH, they are
holding all the cards. My instincts told me that if I turned round and
told them their offer wasn't good enough they would have put up the
corporate brick wall, they have to do this to protect their image.
They simple do not have a choice in the matter. This is the reality of
    what probably would have happened:

    Suzuki withdraws their offer.

The dealer writes to me and asks me what I want to do with the bike.

I get an invoice from the dealer for the time they've already spent.

I arrange to collect my bike after I've paid the dealer's bill.

I get my bike home in pieces.

I then contact a solicitor who will say that I was silly but when I
insist he/she will ask for a sizeable deposit to cover, their fees and
any specialists they have to call in.

Specialist may find some faulty materials but they may not.

Suzuki in the meantime let their corporate legal department grind
    things to a halt.

I've been there before, I know I may have a chance but I also know it'
    s not worth it.

Thanks for your thoughts though mate.

You're not kidding. The kit was awful and the customer service was
    dreadful, it did improve though.
I like to think I did a decent job restructuring them. It was a
nightmare though but I battled through. The main problem wasn't with
the owners or the workers but the middle management and some of the
directors. It took quite a while to get them to get on with their job
rather than just protect their arses. By the time I left complaints
were being dealt with as and when they occurred rather than leaving
them for months. To be fair, we were shipping several thousand PC's
everyday and the failure rate was very low indeed. However, one of the
owners insisted on doing software deals for hundreds of crap packages
(shovelware). It was impossible to test all the bits of software and
it's the compatibility of this software that caused the major problem.

I remember a customer complaining that everytime she switched on a PC
there was a smell. When we got it back someone had left their lunch
inside it. An old age pensioners hall caught fire once when the
monitor caught fire. we got out of that one as well.
