    that bit I am trying to work out, in a court of law, just because the
    other person has to give does that give you 100% right of way. I think
    in majority of cases it does but I have "heard" that portion of blame
    has been awarded to the right of way-ee
    dunno, but the old bit means that they are no longer relevant

    Yep; this is something I tried to teach gNatalie (back before she knew
    everything).
    I'd always say "Oh oh; watch that car" or somesuch because, as you say, it's
    very rare that someone you're "tracking" will do something you haven't
    already anticipated.

    Well; I didn't ACTUALLY say I was wrong.
    OK; it was wrong to exaggerate the details but I'm not saying I was "wrong"
    (as in "incorrect") .....

    Well, if you were far enough behind him to see his tail-lights, and he
    indicated he wanted to change lanes, then I don't think accelerating was a
    good choice.
    And if he had decided you were going to stay behind him and changed lanes
    just as you accelerated?

    I think the law is pretty clear cut. If you are changing lanes, you
    must give way. I can't see law could be applied in such a way that the
    person who must give way could somehow not be in the wrong... unless ,
    there was noone to give way to, but someone put themselves there after
    the fact.

    There have been cases in the past where a person was allotted partial blame
    (I think 25%) because he didn't give way to the car that hit him from his
    right as he went through a green light.

    heh. A few weeks back I was passing through a traffic-lit intersection
    and had a good look at the oncoming car that was indicating to turn
    right. As anticipated, he moved into a position where he could complete
    his turn after I'd passed.
    Except that he didn't stop.
    There was a period of about 0.2 seconds during which his behaviour (not
    stopping) deviated from what I expected (stopping).

    He hit me about eight inches from my right foot. Thank [insert deity of
    choice here] for the bullbar on the front of the 4WD van.

    The guy was happy to accept full responsibility, except he didn't tell
    that to his insurance company. (once again his behaviour departed from
    what I expected).

    Fortunately, the intersection has a red light camera that covers my line
    of approach, and the fact that it didn't go off is pretty good evidence
    that I didn't run a red light, and he didn't have a green arrow (like he
    told his insurance company).
