FOAK: Race cans and points

Discussion in 'UK Motorcycles' started by Mark Derbyshire, Nov 23, 2004.

  1. Could/can a race can attract points on your license?

Simple question - a simple reply will do :0)

Not simply for having one I think, but if you haven't declared it to your
insurance then you could technically be brought up for riding whilst
uninsured against 3rd party risks and that's 6-8 points.

    Other than being illegal [1]?

Anything from unroadworthy, to no insurance, to due care, you name it, they
could throw it at you (AFAIK).

[1] for road use I presume you mean

I would have thought they'd use any excuse to avoid paying out though, and I
would presume an undeclared race can was clearly against their terms (which
you'd have signed somewhere down the line)

A quick Google reveals that Kiran has posted before about "utmost good
faith" which underpins your insurance contract. If the insurance company
ask a question, such as "is the vehicle modified in any way" and you fail to
provide the correct answer then you have breached that faith and the
    contract doesn't hold.

I agree that it's unlikely, but it's possible.

What about the situation where you tell them it has a race can fitted
and they accept it, but then you put the stock can back on?
