Lights on vehicles are controlled by the Vehicles Construction and use Act. Headlights, i.e. main driving lights, must be a minimum height above road level. Anything below that height are deemed to be fog lights, obviously for use in foggy weather conditions. Offical version of adverse weather conditions is when visibility is less than 100 metres.
I was going to tell that to the Janitor in his BMW estate last night if he had pulled me over.(1) I wonder if he was trying to look "cool" or just trying to disguise the fact he *was* a Janitor so that people drove over the limit. Or is that me being cynical? (1) I was doing about *cough* mph in a 30 [1am, nice wide road] when I saw his bonnet appear, turning out of a petrol station 100 yards in front of me. I slowed down to 35 and carried on at that speed and he sat a safe braking distance behind me for the next 1.5 miles. And yes Ace, fog lights are bloody annoying even though they may be showing up more of the road for him!!
