FOAK: Endorsing cheques

    For reasons way too complex to explain, my brother in law was the
    registered keeper of a car I owned.

    He was hit by an idiot the other day. They've admitted full
    responsibility and the cheque is on the way.

    Is it (still) possible for him to sign the cheque over to me, so I can
    pay it into my account?

    I'm planning on buying another car for his use before the cheque
    arrives, and historically getting money out of him has been 'difficult'

    If the cheque is crossed, then no. If it's an insco cheque, the
    chances are that it will be crossed, I'm afraid.

    Hmm. I was afraid that might be the case.
    Credit where it's due, he's played by the rules all this year. We
    wouldn't be in this situation had it not been for another idiot.

  4. Seize the moment, march him down to the bank as soon as the cheque
    clears and fill your hands with his dosh.
    If he has a cheque book (not many do, nowadays) get him to write you one
    as soon as he gets the InsCo one and pays it in.

    While that would be good and well, the actual challenge[1] is quite how
    large his *un-authorised* overdraft is at any given moment.

    Otherwise I would have no issues, I'd simply take the car back[2]

    [1] In this case, at least.
    [2] Which I can clearly still do, but then the whole thing gets a bit
    pointless, which I am trying to avoid.

    Whilst I can understand you wanting to help out a sibling, do you think
    continuing to subsidise the lifestyle they choose is the right course of
    action? Perhaps let them bank the cheque, write off the loss yourself
    and let them sort their transport themsleves from now o?. There are
    probably other alternative but surely maintaining the status quo is not
    addressing the real issues?

  8. If the other party has simply paid out themselves, rather than have an
    insurance claim aganst them, it's unlikely to be crossed, though.

    I hadn't noticed that but thanks to this thread the payment to Colin
    is now winging its way across the wires.

    still needs the form printing and posting though. (I've cheated and
    emailed it him but like a good girl will do as directed).

    Not my sibling, SWMBO's.

    And no, it's not (in any absolute sense) the *right* course of action.
    However, the alternative will punish other who ill deserve it. So I am
    taking pain to reduce the suffering of those.
    Doesn't even come close.

    Ah, yes. It has, however, helped to teach him *something* about
    responsibility.

    Mostly because he has *absolute* no doubt that I would take it back
    should he transgress the rules we agreed. He also knows he can't bully
    me, or even vaguely 'threaten' me without the consequences being
    infinitely worse.

    He really did look after it (unlike previous cars that were bought *for*
    him) and was rather upset when it got totalled.
