They've admitted full responsibility and the cheque is on the way. Is it (still) possible for him to sign the cheque over to me, so I can pay it into my account? If the cheque is crossed, then no. If it's an insco cheque, the chances are that it will be crossed, I'm afraid. <Raises eyebrow>

Seize the moment, march him down to the bank as soon as the cheque clears and fill your hands with his dosh. If he has a cheque book (not many do, nowadays) get him to write you one as soon as he gets the InsCo one and pays it in.
While that would be good and well, the actual challenge[1] is quite how large his *un-authorised* overdraft is at any given moment. Otherwise I would have no issues, I'd simply take the car back[2] [1] In this case, at least. Whilst I can understand you wanting to help out a sibling, do you think continuing to subsidise the lifestyle they choose is the right course of action? Perhaps let them bank the cheque, write off the loss yourself and let them sort their transport themsleves from now o?. There are probably other alternative but surely maintaining the status quo is not addressing the real issues?
If the other party has simply paid out themselves, rather than have an insurance claim aganst them, it's unlikely to be crossed, though.

Ah, yes. It has, however, helped to teach him *something* about responsibility. Mostly because he has *absolute* no doubt that I would take it back should he transgress the rules we agreed. He also knows he can't bully me, or even vaguely 'threaten' me without the consequences being infinitely worse.
