    Madam ordered a new PC for number one son online, which has arrived
    been set up and is now in use.

    She's just had a phone call from the suppliers saying that they've
    sent out the wrong machine and they want to come and get it back. The
    one they've set out is apparently worth about £250 more than the one
    that was ordered.

    When it was ordered they gave a delivery time of 10 days, it actually
    took over a month. He's spend a fair amount of time installing all the
    software (all legit) that he wants to use on it.

    Since the order they sent here has been open, used etc, I think they'd
    be on dodgy ground asking for that back and giving it to some one
    else, as it's now second hand goods.

    I'm inclined to tell them to **** off, but what's the legal position
    on this? Can they demand it back? Do they have to provide us with the
    correct order first?

    I'd say they were questions for your local trading standards department
    if you want definitive answers rather than guesswork - they're a very
    helpful bunch.

    However I'd be tempted to tell them they can have it back just as soon
    as they've paid you £300 to cover the time you've spent installing
    software (& un-installing it before they collect it).

    Or just say NO with a brief explanation of the work done and let them

  6. You could always tell them you've already had the case, monitor and
    keyboard security marked with a non-removable method, i.e. scratched in
    with a compass as a dissuasive measure also. If they're not bothered
    then ask them to put it in writing before you agree to let them have it
    back so you know you're not liable for damage. If that's still ok then
    you'll just have to do it anyway before letting it go.

    Ta to all those that replied. I spoke to them on the phone yesterday
    and refused to let the hard drive leave here unless it was certified
    clear of all data, before leaving the premisis. I suggested that as it
    was their **** up it'd be a nice gesture if they were to let us keep
    the larger drive as an apology. Several hours later they called back
    and agreed. My other concern, that we'd be getting what amounts to a
    second hand machine was covered as the bloke who got ours only got as
    far as checking the documentation before realising it was the wrong
    one.

    Quite how boy child didn't notice, I don't know. As the one he ordered
    had twice as much ram, a higher spec graphics card, a dvd writer and a
    few other bits and bobs that were missing from the one we got. It
    would appear that the reason the other order was more expensive was
    the inclusion of some video editing hardware and software.

    8 o'clock this morning the Citylink courier arrives to take back the
    old one and deliver the new one. I went to plug in the retained hard
    drive, and there's no fucking SATA data cable. A bit of driving about
    later and it's all installed and working.

    Boychild is now happy.

    Whew you let them off *very* lightly! wish all customers were so easy

    How so? TBH It wasn't really worth fucking about any more than that,
    and we got what we ordered. Oh, and I forgot to send back the WinXP
    disk and the wirelss mouse/keyboard so we got that as well as the
    larger hard drive.

    What would you have done?

    Well looking at it as a supplier AND as a customer.
    I would have asked them to come with the replacement and transfer all my
    data and scrub the HDD.
    We would have left you with the PC given as it was opened, as the
    expense and hassle and loss of customer satisfaction would have
    outweighed and rectification.
    I would have written to you apologising and wishing you well with the
    higher spec machine.

    I would then have beaten the despatchers with a spiked club and slashed
    my wrists.

    IF the PC had still been sealed in the box only then would I have tried
    to arrange a replacement.

    I did ask for that, but as the HD we had was bigger than the one we
    were supposed to have, we were happy to keep this one.
    There's the thing though, turns out that we'd got the lower spec one.
    It was more expensive becuase they'd included some fancy video
    edditing stuff. I full agree with the appology though, their attitude
    was appaling, as though the whole episode was our fault.
    The one we now have was still sealed, but the one they sent us first
    was definately well and truely used.

    I'm happy with how it's worked out, but I would be unlikely to use
    them again. That's mostly down to their attitude though - companies
    are filled with people and people make mistakes, it's what happens
    when the mistakes come to light that's important to me.

  12. your story is ringing alarms bells with a similar incident I had in
    2000. The supplier in this case wasn't Scan by any chance?
