    There's taking ideas from other bikes, then there's blatant copyright
    infingement, how can this not come under the later?

    its got a Harley donk in it, so it should be as reliable as a Duc.

    not to mention the over priced merchandise.

    production and design.

    I still think the real one looks better though!

  13. IP Australia say: " A patent is a right granted for any device,
    substance, method or process which is new, inventive and useful. ... You
    *cannot* patent artistic creations, mathematical models, plans, schemes
    or other purely mental processes. " So you *can* patent a method
    provided it is real and not theoretical.

    However, you can register a design and you can assert copyright in
    artistic works. Motorcycles are certainly registerable designs, and any
    modified motorcycle is obviously a work of art and therefore copyright.

    So who's talking about Patent?

    The statement in contention is that a motorcycle design can be
    copyrighted. It can't.

    Copyright and patent are quite distinct concepts.

    He's got you on a technicality, he snuck a patent in there when you
    weren't looking !

    You can't copyright a design, you can copyright the blueprints though...
    you can register a deisgn and patent a unique method of production.

    I dunno if the 999 is a registered design, but I doubt it, you'd be hard
    pressed to claim it was unique enough to be registerable I would have
    thought

    well, that answers my question of how it can't be. But still, i would
    have thought that if you were to create something and put your name to
    it you would make it as much your own as possible.
