FBOTY#2 smidsy settlement!

    total GBP 45,000. Net: GBP 32,500.

    As some of you may remember, the FBOTY#2 was earned
    by me being SMIDSY'd on 29 Jan 2002. The offer by
    the guilty party has been accepted, and I thought
    I'd report back here.

    The accident resulted in:

    a repairable new R1150GS (only had what, 600 miles
    on the clock when the dozy blind bint t-boned me?),
    now owned by someone else of this parish unless he's
    sold it on. (how's it running? What's the mileage?)

    a not so repairable but suitably bodged left knee which
    has cost UKP 12,000 so far in operations and may cost
    more later. If anyone finds my kneecap I want it back.

    On barrister's advice (paraphrasing: It's a bloody
    generous offer and you're stupid if you don't take it.
    I may be slow, but I'm not that stupid.) I've insurance
    offer of GBP 45,000 for pain, suffering, loss of income,
    and several other things we sorta threw into the
    pile. Solicitors fees to be recovered separately.

    So net of about GBP 32,500 in damages to my account.

    That should pay for a couple years of university.
    I really need to make the money last though, so no
    new bike for me.

    I's chuffed.

    place.

    settlement was you'd still rather it never happened.

    Got it in one.
    Not much else to do now. I'm apparently due for a
    replacement in 15 years or so and I still can't walk
    for any distance. Oh well. At least this fucking
    court case is over, and I now (well, in a few weeks)
    have enough money to pay for stuff again.

    Result! As per others (being FBOTY 2003 and having crushed vertibrae and
    damaged back muscles) I'm sure you'd rather have not been there. My claim
    is still pending. I'm on weekly physio(with acupuncture this week) but the
    X Rays show the break to to stable(loss of 33% height at the front of L1)

    Sigh. Yes, it would. If the accident had
    been in the US I'd have gotten it too. But it
    was in the UK, where the settlements seem to
    be dictated by the insurance companies, who
    will generally pay the least possible.
    For a UK settlement, it was pretty good. ish.

    I was trying to be fucking positive for once!

    Pity it wasn't more though.

    £32k should be enough to pay for a whole course! The student grants
    only about £2k a year and that suposedly gives enough to live on (if
    you like living in a hovel and eating Aldi beans :)

    I don't think it makes up for it at all. I was going by previous cases
    I'd heard about where the victim didn't get anywhere near as much for
    losing a kneecap. In that respect marc got a good result, because I
    dare say he wouldn't have got any more had he hung it out, just a
    shitload more stress to add to what he's already suffered.
