    Anyone skilled in the above?

    I have a question I'd like to ask if something is legal or not.

    I am handing in my resignation tomorrow(1 months notice) with my Global IT
    employer as I have another offer with more cash/better prospects etc. Now
    in my March pay packet payable 31st March I should be getting a bonus
    which is based on last years performance rating(~3.5K). Can they legally
    withhold it?

    I asked for a copy of my contract to check and the last one I signed was
    10 years ago when I started working in a Call Centre for a company that
    outsourced me to my current employer 3 years ago. The contract doesn't
    mention a bonus in any shape or form and therefore also doesn't mention
    any forefit should I be working my notice. Can they apply any changes to
    my contract without me signing anything even if they have provided some
    written notice ( I did get some "Welcome to XXX" docs when I was
    outsourced but can't find them ATM so I can't check if it says anything)

  3. I would imagine there is a clause in your employment contract somewhere
    that will allow them to do so.
    IME employers can change what they like regardless of whether you like
    it or not, agree to it or not or sign a revised contract or not. Our
    bonus scheme, revised pay and pension arrangements were introduced
    without a change to our employment contract.

    Wait until you're paid then advise them that you're off to their biggest
    competitor and then agree to waive the notice. If your a good negotiator you
    may even be paid a month in lieue.

    Common sense would suggest waiting until the pay packet arrives? it's
    not long.

    Whether you get it or not otherwise is as likely or not down to the
    level of friendliness with your Line Management

    Would you lose the new job offer if you couldn't take up your new
    position for another 4 weeks and if not then is your new job worth
    £3.5k per month more?

    If you've answered no to both those questions then why didn't you
    explain the situation to your new employer and ask to start after
    you'd got your hands on the bonus?
