DVLA have conceded and are now allowing me to re-apply for my group 2 driving licences[1]. Its not a total victory, I will still have to declare the licence revokation for insurance purposes which will make me almost uninsurable for the next 3 to 5 years, but I would have had to do that in 4 years time anyway. If we could have got DVLA into court we may have been able to overturn the revokation or at least a greater part of it but they were unwilling to risk a test case going against them. Because they have admitted defeat, If they had not agreed to allowing me to drive group 2 vehicles then my next step would have been to despute their original revokation of my group 2 licences, this would have been in court. The original revokation of my group 2 licences was for 7 years, this was the time that DVLA said that I needed for my epilepsy risk to drop to below 2% per year as per their calculations from certain medical data. It took a considerable amount of time to get specific information from DVLA, once we had got this information it was at first cross checked with a number of medical experts but unfortunately it looked as if DVLA had got their information right. We then brought in a medical statistician to review the data that the decision was originally based on, he spotted a flaw in their interpretation of the data, and we brought this to the attention of DVLA and they have not in so many words admitted defeat. Unfortunately the revised interpretation of the data shows that I would have been within DVLA's epilepsy risk level at the 2 year point, ie 14 months ago. If it had gone to court, the court may have backdated the date of the end of the revokation, this would have been an advantage because I will have to declare the revokation for insurance purposes for the next 3 to 5 years, revokations are treated by insurance co's the same or similar to bans, this will effect my job hunting prospects. -- Kevin - Basildon XV535 GPZ305 (her's) BOTAFOT#67 BOTAFOF#23 OSOS#29

Did they use the word "revoke" or did they say something like "suspended on medical grounds"? The wording is "your licence is revoked" Yep, insurance co's are not allowed to discriminate against disabled drivers, this only seems to apply to private use, when you cross the line into commercial driving whether it be white van man or HGV you start to see a single question, "Have you had a ban or revokation in the last x years", this question requires a yes - no answer, the wrong answer and they will not insure you, if a company cannot insure you they cannot hire you. -- Kevin - Basildon XV535 GPZ305 (her's) BOTAFOT#67 BOTAFOF#23 OSOS#29
Cannot do it, put me in front of a group of people and ask me to speak and I freeze up, The best I can do is instruct to small groups on a hands on type practical subject such as basic rockclimbing or first aid.
