Drinking whilst being driven...

  1. Greetings All

    Coming back from the Henty Machinery Field Day yesterday, I was told about a
    law I'd never heard of.

    The law allegedly goes some thing like ....It is illegal to have an open
    container of alcohol in your possession whilst travelling in or on a
    vehicle..."

    I laughed and continued on my way, but not before making a large wager that
    it was bollocks.

    Is it real or just, bollocks?

    I believe that law to be true.

    No guarantees though.

    PART II - OFFENCES RELATED TO THE TAKING OF ALCOHOL AND DRUGS AND THE
    DETECTION THEREOF

    Division 1 - Driving under the influence of alcohol or drugs

    Consumption, &c., of intoxicating liquor in motor vehicles

    7. (1) No person shall drive a motor vehicle while he is consuming
    intoxicating liquor.

    (2) No person shall drive a motor vehicle while any person in the
    vehicle is, to his knowledge, consuming intoxicating liquor.

    (3) No person shall, in a motor vehicle that is in motion, consume any
    intoxicating liquor.

    (3A) Subsections (2) and (3) do not apply to a person in a public
    passenger vehicle as defined in the Passenger Transport Act 1997 if there is
    a liquor permit in force under Division 3 of Part 2 of the Liquor and
    Accommodation Act 1990 in respect of that public passenger vehicle.

    (4) A person who contravenes any provision of this section is guilty
    of an offence.

    In Victoria you are still allowed to drive and drink as long as you are
    under .05 but that law is under review as I speak.

    yeah its tassie, remember a few years ago most of the road rules went
    national?

    I picked tassie because we have one of the most easy to use
    legislation databases around

    not sure if there is a specific vehicle related law targeting offence

    over here you could be done for street drinking but it would be rare

    Well, exactly. And it's open to abuse too. If the passenger is
    having a beer, and they put the beer in the nifty cupholder thing
    in the middle, is that in possession of the driver? How about
    if there's a 95% empty tinnie floating around under the drivers
    seat? Does half a bottle of whiskey count if you've put the
    lid back on? How about an empty shot glass in the driver's hand?
    Or a hipflask in the pocket of his riding jacket?

    I used to drive up the Hume Hwy from Melbourne to Violet Town every weekend.
    Almost never did the trip without taking a couple of 'travellers'. Heading
    north, the turnoff to Beveridge always seemed to be the appropriate place to
    crack the first one open.
