dilema

    So I've thought about it and I'm struggling to come up with a solution so
    what would you lot do.

    last July sister in laws fella was interested in buying the Varadero from
    me. I wanted to sell it as it was depreciating and with arrival of Siobhan
    I knew I wouldn't get out much for a year or so. Anyway, he couldn't
    afford to buy it outright so I came up with a deal that suited both of us.
    He paid a deposit of 1200 quid with the balance payable in 12 months. He
    took the bike and has used it quite often (7K miles). Anyway a few weeks
    ago he dumps SIL. Hes been saving up at £50 a week to pay the balance by
    giving it to SIL. There is just over 1200 quid in the pot. However, it
    turns out that SIL had leant him the 1200 that was used for deposit and is
    keeping the cash so she isn't out of pocket[1]

    So hes got no chance of getting the cash together by the date agreed. At
    the rate he can afford to payback its August 2007 before I'd have my
    money. I've taken 1200 against the bike but its now worth less than it
    was. Tog has valued it at about 800 quid less than I sold it for. Being
    honest I'm not particularly interested in it[2] so feel rather pee'd that
    its coming back. Up to now I'm thinking of giving him a bit of cash back[3]

    Can anyone think of a solution that I haven't considered? Up to now I've
    agreed that we could extend the deadline a bit but nowhere near another 12
    months. He can't come up with the cash any quicker through other reasons.


    [1] he dumped her 2 days after she found out shes being made redundant
    [2] I enjoy riding it but to be honest I've moved on and I'm enjoying the
    Guzzi, however SWMBO does like the Varadero but I can't justify both in
    the garage.
    [3] I don't see why I should be out of pocket because his situation is all
    fs*ked up through his own 'doing'[4]
    [4] Its a bit strange as to why he dumped her, absolutely no-one saw it
    coming including SIL, one day they are fine, the next hes dumped her

    I'd rather it be amicable, TBH I doubt I'd get anywhere that way due to
    other knowledge I have.

    My name isn't on the V5 as he needed to be registered keeper to insure it.
    As you say, if I sell it on open market then I'll see how it all settles,
    I'm more than happy to let it go to him for the agreed price. I can't see
    him being happy at being £800 down in 12 months though. As I said thats
    not my problem and I'm not being out of pocket for trying to do someone a
    favour.

    Bikes in my garage with a chain round its back wheel. whilst I 'want' to
    trust him I can't afford to lose £2K. whilst he was with SIL there was a
    guarantee type feeling, now thats all gone

  6. Well, it depends on what nick it's in, as I said in my valuation. If you
    sold it to him nearly a year ago, and he's put 7k on it, and it needs
    some work, I don't see that a year's depreciation of £800 is out of
    court.

    Offer him 6 weeks to sell the bike and pay you back all he owes, then
    suggest an alternative would be to sign the V5 back to you so you can
    sell it and he can walk away.

    They're the only options in my book.

    More importantly..... entwisi still has the bike in his garage. If he
    can get hold of the V5, he doesn't even need to have it signed over to
    him, the DVLA will process the form with any squiggle on it as a
    'signature'.

    Oh yes. Which is another reason why forging a signature on a V5 is dumb.

    They also process the change of keeper without the current/old keeper
    signing it at all.

    I did a car with only my signature as the 'new' keeper and the DVLA
    didn't seem to care.
