demerit points and speading fines

    Just got caught doing 86km in a 50km zone.

    11 pm at night , no street lights no house and a cop car hiding in the dark.

    200m of 86km means my license is suspended for 3 months. plus 4 demerit
    points plus $575 fine. no matter how many points are still on my gold
    license.

    Has anyone got out of this before?

    and how long does the demerit system last?
    Can I loose 12 points over 10 years and have my license suspended for 3
    months?

    or

    is it 12 points on one year, or do the points wind back to zero if you are
    clean for 12 months?

    the RTA web site does not give me any answers.

    Spreading is a very serious offence :)

    You can lose 12 points in ONE year, then your license is revoked for a
    period which I don't know.
    Seriously, whats to complain about? you were speeding right? Why would
    you want to get off it unless you werent doing what the cop said you were
    doing?

    Theres a solicitor who advertises in AMCN and cycletorque who specialises in
    bike matters, give him a call. The first one I found in the latest edition
    of CT was "Kalpage & Co" on 02 9230 0448 for NSW. You didnt where you are
    though.

    If you choose to write a letter, only bother if you have 10 years of a
    perfect record, it'll likely be ignored if not.

    Personally I think if your doing the speed then you should know you can get
    caught, pretty simple. Good luck either way.

    Doesn't make it right.
    Speeding laws/enforcement are fucked and everyone knows it. Your best bet is
    to go and steal something to make up for it.

    Uncle Bully, your 100% right, the cops don't care about property crimes,
    only speeding and murders.

    I have had 2 cars stolen and have been burgled 3 times in 10 years and the
    cops did nothing, even though my Mazda was stolen whilst parked outside
    Bondi Police Station.

    I really like the new Speed tripple! any body need an insurance job? blast
    can't steel a bike and ride away if you licence is suspended.

    Well, let's see... 86 minus 50 equals 36.

    If you are done for more than thirty over the limit, your licence is
    suspended.

    End of story.

    Only exceptions are _very_ rich people who have radio programs or TV shows.

    This is pretty scarey tho, 'cos I could actually get my licence
    suspended for 30 over, even on the Z50!

    A joker over here in NZ had a lever by the tank that pulled a cable to
    lift the number plate horizontal when he was doing a runner. Got caught
    but. Know your territory - walkways, steps, alleys - where your bike
    can go and a cop car can't follow. Poof! Magic! No bike! No ticket!

    36 over. That was a bit silly, wasn't it.

    Makes you look even sillier, doesn't it. It is my experience
    that cop cars hide in the dark all the time. Often they have
    cops in them too.

    All that for a measly two hundred metres. Now you're looking
    like a right idiot!

    BTW: "Gold" doesn't mean what you think it means. Nowadays,
    "Gold" means that you paid up-front for 5 years. It gives no
    indication of how good a driver you aren't.


    Yep. Like Cam said, rich kids and radio stars do it all the
    time (well, they did, until video killed them).


    Chances are it will last forever. It gives the government
    justification for their claims that they're Doing Something(tm),
    so I can hardly see them taking it away.


    If you'd like, yes. Getting caught doing 36 over would be a
    good way to make this happen.


    You'd have to wash a lot of police cars on saturday mornings
    to make that happen methinks.

    Some pertinent excerpts:

    - "A driver who has not committed any offences has zero points.
    When an offence that carries demerit points is committed, the
    points are added to the licence holder’s driving record. If a
    certain number of demerit points are accumulated, their licence
    will be suspended or application for renewal refused. The number
    of points accumulated varies for different licence types as follows:

    * Full unrestricted licence holders (gold, silver or magenta) -
    12 demerit points in a three year period."

    - "The RTA may refuse to renew a licence for a driver who have exceeded
    their demerit points limit or has committed a serious speeding
    offence."

    - "Licence holders may have their licence suspended or disqualified
    for the following serious speeding offences:[...]

    * Driving more than 30 km/h but not more than 45 km/h above the
    speed limit – suspension or disqualification for three months."

    - "In addition to the suspension and disqualification periods, these
    offences also carry demerit points which are added to the licence
    holder’s record. If the licence holder reaches or exceeds their
    demerit points limit, these points may contribute to an additional
    suspension or refusal period."


    It seems very clear to me. Which parts of that don't you
    understand?

  9. The essential information not given so far, either here or on the RTA
    site, is that demerit points you get are removed three years after you
    got them.

    So if I get up to 11 points after receiving a four-point demerit, but I
    received my earliest three demerit points two years and nine months
    ago, then in three months from now I'm back to 11-3=8 points.

    If the 4 points took you over the 12 point mark, you will be suspended
    until your earliest points expire, as I understand it.

    Which part of "12 demerit points in a three year period" is
    confusing you? In context of the surrounding sentences, it's
    pretty clear to me that 'earning' 12 points inside of three
    years will earn you a suspension. It's equally clear to me, albeit
    by implication, that points must dissapear three years after
    you earn them.

    Used to be 3 years for points to expire and drop off, don't think it's
    been changed- it is on the RTA website somewhere (but it's a shockingly
    bad website to find anything on)

    There was talk of upping it to five years. I had a bit of a
    heart attack when I did my thirty-<mumble> over last year, was
    relieved to find that the three year thing still stood!

    Suck it up, man. Wear it, and enjoy walking.

    For those who said the police don't care about property crimes... I
    agree to a point. But you'd also be the first to whinge about taxes
    doubling because of the extra 10,000 cops we'd need to follow up on
    every property issue that was reported. After all, that's what
    insurance is for.

    Let the cops concentrate on more important issues.

    And yes.. speeding IS important. Just ask my neighbour who's 4 year old
    was mowed down by a guy doing 85 in a 50 zone...

    guy was driving like an idiot / the kid wandered onto the road ? What
    was a 4 year old doing unsupervised on a roadway anyway ?

    year old was on the street and btw what the hell was a 4 year doing on the
    street ?

    and the worst offenders for speeding have always been the boy racers in cop
