    I'm more of a timid rider than you two and, while I'm happy to
    undertake at three figure speeds if there's plenty of escape room, I
    would not normally go between cars (as darsy does in the first
    undertake and you pretty much do in the second) at that sort of speed.

    I'm not saying any of us are right or wrong, but if I can draw a
    distinction as above then maybe a magistrate will too.

  16. As I understand it, the "guilty to speeding, not guilty to due care" was a
    strategy to tempt the CPS into going for the quick win on speeding and
    dropping the other charge. As they haven't taken that bait, the strategy
    has failed and you need to come up with an new plan. I'm afraid bending
    over appears to be the lesser of two evils here.

    I tend to agree most drivers would consider that move a lack of Due Care
    though I do the same all the time. I jump sometimes myself in the cage when
    bikes come by so.
    Must do it at far greater speed such that capture is not an option.

    Deffo not IMHO.
    I would be looking for a stay to recruit expert witnesses. CPS are not daft,
    they can take the game of bluff to the wall too.

    Trouble is the dynamic duo have not made the moves and noises to suggest
    they are really serious about fighting it. It's a game and battle rules
    apply.

    Pardon? Personally I wouldn't recommend a change of plea simply on the
    grounds they are /not/ guilty IMO. But...

    It would only be sub judice if either Stu or JP were directly involved or
    likely to be involved.

    As to contempt I'm not sure where you're coming from. It would certainly
    be in order to change a plea "in light of the video evidence".

    My view, however, would be in light of the video evidence "get your
    fucking plod recruitment policies sorted, wankers"

    Although I suspect that may be considered contemptuous.
