Busted riding my R1100GS with an unrestrained load

    Actually it does, it is my understanding that legislation was passed a couple of
    years ago requiring dogs to be tethered whilst in the backs of utes and in similar
    situations, ie. not wholly enclosed inside a vehicle iirc. Someone with a bit more
    enthusiasm would have to do the research on it though as I couldn't be bothered atm.
    Scary as it may seem the copper may actually be right, anally retentive about it, but
    right nonetheless.

    I can assure you its now law. if I take my Hounds on the ute its tied
    up or cop a solid fine , and the tethering has to done safely

    Thanks for all the responses and interest.

    Whilst having a closer look at the infringement notice I noted that the
    officer failed to take my rego plate details correctly (1 letter obviously
    incorrect) and also failed to fill I another 5 areas on the ticket such as
    my licence type, expiry date, postcode, VIN & rego expiry date. I imagine
    this would help me fight the ticket but I'm not only interested in getting
    the fine waived, I really do enjoy travelling with my most faithful
    companion and would be seeking some sort of exemption if I could prove my
    dogs ability to "pillion". If there are any legal eagles out there who could
    make further judgement on whether this is worth pursuing please email me
    directly. And yes Boxer thanks for the offer, as a newly joined member of
    the BMW club I will be giving you a call shortly.

    She lies on the BM tank and sits on the WLA's tank and I would never
    consider putting her on my lap whilst driving the car.

    Lawyers are paid to manipulate the law in any way you want it. Whether
    or not they succeed is determined by the courts.

    Cops and public servants are paid to enforce the law as interpreted by
    the government.

    Law and justice are not congruent or ontologically identical constructs!

    I was always under the impression that the fines imposed for unrestrained
    loads was there to stop people from towing trailers where the contents of
    the trailer was not tied down and therefore could create a hazard for other
    raod users when 'bits' fly off.....

    If you point out to the police that they have failed to issue you with a valid
    infringement notice they will withdraw that infringement notice....

    Some riders I've seen attach a lead from the dog to the jacket. That would
    technically 'secure the load' even if the rider is no more secure than the
    dog. Failing that, it's a Current Affair kind of story. The logic of
    insisting the dog is secured while the rider isn't is kinda stupid (just
    don't expect any backup sympathy from the RSPCA)

    Was this law introduced to protect the dog or to protect the
    pedestrians who were in danger of being attacked by an unrestrained
    dog?

    Anyway, why not put a lead on the dog and tie it to the handle bars?
    Yes I see the problem with that in the case of a crash but there is
    probably a solution for that as well...

    Unrestrained load... Hmm... So is a dog really a "load"? How do they define
    "load"? What about a human passenger? What about a human rider, for that
    matter?

    The law requiring dogs etc to be restrained in the back of utes is IIRC for
    the safety of a) the dog, and b) innocent bystanders who might get hit by
    said dog if it happens to leap from the moving vehicle. If you can prove
    that a) doesn't rate 'cause it's safer for the dog to be able to leave the
    motorcycle if it goes down, and b) is negligible 'cause your arms are around
    the dog anyway, then you should have a chance. Provided, of course, that the
    beak who gets to rule on the case isn't a cat person :)

    I'd take it to court regardless. If you lose, just work up some rudimentary
    "restraint" like a quick-release clip for a lead attached to their collar,
    and problem solvered. Either way, they can't stop you from taking the dog on
    the bike; just from doing it without any form of restraint.

    Actually what the cop is saying is that every farmer riding down the
    road with his sheepdog (s) on the bike is breaking the law.

    What crap.

    I'd like to see the same cop try and take that argument on in court.

    It sounds to me like the cop was just out to get the rider in
    question, or he didnt get to bang the wife the night before.

    Its a bad one........not exactly good for police P.R.....but then it
    is Queensland.

    Clem I believe dogs have to be restrained in utes these days .
    esp in Mexico.
    Seen plenty of dogs riding on tanks , just civer the tank with
    wetsuit type material so they can dig their claws in and hang on.
    A well known identity on the Mornington Peninsula used to ride
    with a Border Collie type dog on the tank . Some townies even
    tried to round him and dog up doing Arthurs Seat , hahha ,
    some chance they had , its almost his driveway.

    i don't know about the Qld legal situation
    but judging by the vehicles i see here in Tvl
    i presume that a similar law prolly applies here as well
