Blow into this sir.....

    Got a tug this evening on the way home a bit early on the FJ. Just about to
    get round a DHL van before entering a 30 zone but the van slowed right up,
    seeming that he was looking for an address, but Mr Plod appears from the
    bushes on the opposite side of the road just as I opened it up a 'bit' .
    Shit.
    Pulled over, took my lid off and wandered back to him. His mate was
    breathalising some woman in a Rover just round a hidden corner.
    He asks for the the usual details, makes a comment about me being in a rush
    to get home and doesn't blame me "as it's a bit parky tonight for riding",
    and then goes off to get the breathaliser machine from his mate. Comes back
    looking a bit sheepish. "seems like the batteries have died in our
    breathaliser!" "You might as well be on your way then". Pretty surreal.
    Having not had a drop since teatime Sunday, I was quite looking forward to
    my first crack at one of these tests for the first time in 25 years riding.
    No doubt there will be another opportunity this xmas, as they do appear a
    bit keen round here this year.

    Crash. They'll come round to the hospital and offer you the opportunity,
    notwithstanding the fact that you've got a broken collar bone, a broken
    shoulder blade, and three broken ribs, are ripped to the tits on morphine,
    and are gasping nineteen to the dozen into an oxygen mask.

    staff said they could have as much as they could mop off the floor.

    I was as pissed as a rat and very unconcious at the time. I didn't know
    anything about it, one of my nurse friends told me the story after I was
    out of ICU. I was just about sober then too, 3 weeks later.

    AFAIK, the hospital can't give them a blood sample without the patient's
    express permission. Patient confidentiality and all that.

    Don't you need to give permission yourself ?
    if you're in no fit state, they have to wait for your permission?
    is this right or as I suspect a load of bollox?

    They gave the police a bood sample in April without my permission.

    Breach of PACE and therefore if you were over the limit the sample could
    not be used as evidence. See

    "Requests for blood or urine samples at hospital
    When a driver is at a hospital as a patient he cannot be required to
    provide a breath sample and the conditions contained in section 9 (Stones
    7-1379A) regarding medical consent must be complied with before he is
    required to provide a laboratory sample. Furthermore, the investigating
    officer must ask the driver if there is any reason why a specimen of blood
    should not be taken. The correct procedure is detailed in the MG/DD/C"

    Because the hospital won't be testing the alcohol level routinely, so
    can't supply the result, and it's none of the hospital's business to
    supply the police with a patient's blood. Besides, if taken without
    consent it would be inadmissible anyway.

    There's also the risk (in a serious trauma) of the blood being
    contaminated with stomach contents. ISTR that being an issue with
    Princess Di's driver.
